SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a contract between the City of Denton and Rehrig
Pacific Company, amending the contract approved by City Council on January 15, 2019, in the not-to-
exceed amount of $1,010,208; amended by Amendment 1 approved by Purchasing, said second amendment
to provide for the additional purchase of residential refuse and recycling carts and replacement parts;
providing for the expenditure of funds therefor; and providing an effective date (File 6926 – providing for
an additional second amendment expenditure amount not-to-exceed $190,000, with the total contract
amount not-to-exceed $1,200,208).
INFORMATION/BACKGROUND
The Solid Waste and Recycling Department purchases refuse and recycling carts due to wear and tear, loss,
and residential growth occurring within the City of Denton. Additional carts are needed to serve customers
within newly annexed areas and to upsize or downsize existing carts in service. With the onset of COVID
19 the department has seen an uptick in requests for cart repairs and changes to service levels. Additionally,
the department rolled out a new cart based downtown valet service and yard waste service program in
October 2019. This program offered customers the opportunity to opt-in to a yard waste cart service. This
program has been successful with over 6,000 customers requesting yard waste carts. These carts and the
addition requests related to COVID 19 were unforeseen when this contract was awarded on January 15,
2019. This requested increased expenditure authority will provide additional carts to maintain customer
requests through the end of 2020.
Rehrig Pacific Company has been the provider of the City’s residential refuse and recycling carts since
2008. In the Fall of 2020 the department will solicit to procure a new multi-year agreement.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On January 15, 2019, City Council approved a contract with Rehrig Pacific Company, in the not-to-exceed
amount of $1,010,208 (Ordinance 19-061).
On September 11, 2019, Purchasing approved a first amendment with Rehrig Pacific Company, to add line
items to the existing contract.

On September 14, 2020, this item was presented to the Public Utilities Board (PUB) for approval
recommendation.
RECOMMENDATION
Award Amendment No. 2 with Rehrig Pacific Company, for the additional purchase of residential refuse
and recycling carts and replacement parts, in the not-to-exceed amount $190,000, for a total amended
contract amount of $1,200,208.

FISCAL INFORMATION
These services will be funded through department operating budgets on an as needed basis. The City will
only pay for services rendered and is not obligated to pay the full contract amount unless needed.
