Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement and Compliance ACM: David Gaines DATE: October 13, 2020 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, rejecting any and all competitive bids under IFB 7463 for Landscape & Grounds Maintenance; and providing an effective date (IFB 7463). INFORMATION/BACKGROUND Securing a contract will allow the Solid Waste Facilities year-round maintenance of trees, bushes, grass, flower beds and irrigation systems, as well as to comply with the mediated settlement agreement in the municipal solid waste permit number 1590A. We currently have a full-time employee keeping up with mowing and weed control (weed trimming). This employee is not adequately trained or equipped to perform irrigation repairs or new installations of trees or irrigation systems. Irrigation systems in place are failing due to lack of regular and annual maintenance, in turn some trees and bushes have died. In the current City of Denton Municipal Solid Waste Permit number 1590-A in the Mediated Settlement Agreement, Points of Agreement, part (XI.) states: Applicant shall landscape the “Buffer Zone” area along Mayhill Road and at least ¼ mile down Foster Road in accordance with the Special Use Permit for the landfill. For every 100 linear feet of frontage along Mayhill Road and Edwardes Road, Applicant agrees to provide at least seven canopy and thirteen understory trees. Applicant agrees to meet with a representative of the Protestants’ choice to determine the percentage of evergreen trees to be used in the landscaping plan, in any event which shall not fall below 30% (thirty percent). Through the advertisement process only one vendor placed a bid. The pricing/sheet was not itemized properly and by Procurement regulations this bid is requested to be rejected. In accordance with the Local Government Code 252.043, the City Council may reject any and all bids. RECOMMENDATION Staff recommends rejection of all bids for Landscape & Grounds Maintenance.
