SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of Change Order No. 2 to the contract between the City of Denton and Quality
Excavation, LLC, for additional work on the Hinkle and Windsor Paving and Drainage Project (Magnolia
PH II); providing for the expenditure of funds therefor; and providing an effective date (IFB 6902 – Change
Order No. 2 in the not-to-exceed amount of $494,958.57 for a total contract award aggregated to
$7,240,961.78). The Public Utilities Board recommends approval (6 - 0).
INFORMATION/BACKGROUND
The Magnolia Drainage project was developed in order to improve stormwater drainage conditions and
prevent flooding along Hinkle Drive and adjacent neighborhoods.
Phase I of the project consisted of the design and construction of a stormwater detention basin north of West
Windsor Drive between Windsor and North Elm Street. Phase II of the project consists of the reconstruction
of Hinkle Drive and a portion of Windsor Drive with sidewalk and curb repairs, associated storm drain
improvements, sanitary sewer improvements, and water line adjustments. The design of storm drain
improvements will address flooding in portions of the Headlee Addition residential subdivision. Storm drain
improvements will be installed on Windsor Drive and Hinkle Drive. Sanitary sewer improvements will be
made on Hinkle Drive and full pavement replacement will occur on Hinkle Drive from University Drive to
Windsor Drive and Windsor Drive from Hinkle Drive to Elm Street.
Change Order Number 1 was approved on February 11, 2020, in order to compensate the contractor for
various additional items associated with the construction of the roundabout at the intersection of Hinkle
Drive and Mimosa Drive that were not in the original bid plans. These items included:
• Additional curb and gutter, subgrade preparation, and pavement;
• Adding stamped concrete to the scope of work; and
• Additional storm sewer and sanitary sewer relocations associated with widening the roadway at
Hinkle Drive and Mimosa Drive.
Change Order Number 2 is required to address additional work that was not included in the initial plans
and was not discovered until after the project was under construction. A large cost savings that helped to
reduce the impact of this change order was gained by standardizing the base pavement thickness on
Windsor Drive. The original thickness varied between 9” and 12” and was planned to be replaced in kind,

but an equal product was constructed by leveling the subgrade and maintaining the pavement thickness at
9”. The remainder of Change Order Number 2 is associated with the following items:
• Unexpected rock excavation during installation of the storm drain;
• Addition of valves on the 16” water line in order to gain isolation areas and reduce impacts of
water main shutdowns; and
• Addition of signage and striping along Hinkle Drive for protected bike lanes.
PRIOR ACTION/REVIEW (Council, Boards, Commissions)
On February 5, 2019, City Council approved a contract with Quality Excavation LTD., in the not-to-exceed
amount of $6,227,259 (Ordinance 19-165).
On February 11, 2020, City Council approved a Change Order No. 1 with Quality Excavation LLC, in the
not-to-exceed amount of $518,744.21 (Ordinance 20-390).
On October 12, 2020, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award Change Order No. 2 with Quality Excavation, LLC, for additional work on the Hinkle and Windsor
Paving and Drainage Project (Magnolia PH II), in the not-to-exceed amount $494,958.57, for a total
amended contract amount of $7,240,961.78.

ESTIMATED SCHEDULE OF PROJECT
Magnolia Phase II was completed by June 18, 2020. This change order does not affect the project
completion date.
FISCAL INFORMATION
These services will be funded from a combination of funds including: General Obligation Bonds,
Drainage and Water Funds.
