SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute an Interlocal Cooperation Agreement with Denton County, under
Texas Government Code, Chapter 791, to the exchange of Dark Fiber Services for the Technology Services
Department; authorizing the expenditure of funds therefor; and declaring an effective date (File 7472 –
award an Interlocal Cooperation Agreement with Denton County, for a five (5) year term).
INFORMATION /BACKGROUND
The City of Denton and Denton County utilize fiber optic communications between a variety of City and
County buildings and structures. The City and County support hundreds of miles of fiber that span the City
and the County. The City has plans to create a backup location for Public Safety Communications (911
Dispatch) at a location in Lewisville that would require 22 miles of fiber that Denton County already has in
place. This location would function in the event that the present location was to be destroyed or become
inoperable. The backup location would be diverse enough, and with the County’s dark fiber
communications, could provide the dispatchers with the tools and services to continue working if a
catastrophic event occurred in the City.
The proposed agreement allows the City and County to pool their respective resources resulting in a cost
savings to both organizations. This agreement includes a fair value exchange of 22 miles of fiber rounded
to the closest mile at no cost to the City or County. Any construction cost above and beyond what currently
exists will be provided by the requestor of such services. Dark fiber above this amount would be negotiated
on a year by year basis at a rate that both parties agree to.

Chapter 791 of the Texas Government Code requires that Interlocal Cooperation Agreements be authorized
by the governing body, regardless of amount.
RECOMMENDATION
Award an Interlocal Cooperation Agreement with Denton County, for the exchange of dark fiber services
for the Technology Services Department, for a five (5) year term.

FISCAL INFORMATION
These lease of 22 miles of Denton County’s dark fiber will be at no charge to the City. The construction
cost related this agreement is $7,300.20, which will be funded from the Technology Service Operating
Budget.
