Exhibit 1 - Agenda Information Sheet - Amendment 1City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: October 27, 2020 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, amending Ordinance No. 20-1064 and authorizing the City Manager to execute a contract with Texas Excavation Safety System, Inc., for the continuation of the services for utility line locates for the Water Distribution Department, Wastewater Collections, Water Metering, and Denton Municipal Electric Department provided by Texas 811, which is the sole provider of these commodities and services, in accordance with Texas Local Government Code 252.022, which provides that procurement of commodities and services that are available from one source are exempt from competitive bidding, and if over $50,000 shall be awarded by the governing body; and providing an effective date (File 7336 – awarded to Texas Excavation Safety System, Inc., in the five (5) year not-to-exceed amount of $300,000). INFORMATION/BACKGROUND On June 16, 2020 City Council approved an ordinance to contract for notifications of excavations (line locates). This proposed amendment to ordinance 20-1064 replaces the name Centricity GIS with Texas Excavation Safety System Inc. also known as Texas 811, which is the sole source provider for line location notifications within the State of Texas. The Texas 811 system is a sole source program that is utilized throughout the state and is required by law. All excavator shall request the location of underground pipelines at each excavation site by giving notice to the notification center as required by Texas Utilities Code, Chapter 251. The City of Denton utilizes the Texas 811 notification center to notify other utilities and to receive notification of any digging operations that are occurring within the City of Denton. The City currently has a multitude of contractors combined with our own construction and maintenance that is taking place throughout the City and utilization of this notification center assists with preventing damage to other utilities as well as our own infrastructure. Based on a historical spend and future projections the recommended not- to-exceed amount for this contract is $300,000 for a total potential five (5) year contract. Texas Underground Facility DIG SAFELY is a nationally recognized safety program developed by an industry wide group of experts from all stakeholder groups including excavators and utility operators. The purpose is to increase excavation safety and reduce dangerous and expensive damage to vital underground utilities. The Office of Pipeline Safety of the US Department of Transportation introduced it. The DIG SAFELY message is at the heart of the Texas One-Call law: City Hall 215 E. On June 16, 2020, City Council approved a contract with Centricity GIS, in the not-to-exceed amount of $300,000 (Ordinance 20-1064). RECOMMENDATION Amending ordinance 20-1064 to award Texas Excavation Safety System, Inc. for the continuation of the services for utility line locates for the Water Distribution Department, Wastewater Collections, Water Metering, and Denton Municipal Electric Department provided by Texas 811, in a five (5) year not-to- exceed amount of $300,000. FISCAL INFORMATION These products and services will be funded through the using department’s budget on an as needed basis. The City will only pay for services rendered and is not obligated to pay the full contract amount unless needed.
