Exhibit 1 - Agenda Information Sheet - CO 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: December 17, 2020 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of Change Order No. 2 to the contract between the City of Denton and Thalle Construction Company, Inc., for the construction of the North South Phase II 36-inch/42-inch Water Transmission Line Project for the City of Denton; providing for the expenditure of funds therefor; and providing an effective date (IFB 6901 – Change Order No. 2 in the not-to-exceed amount of $113,189.27 for a total contract award aggregated to $7,944,136.98). INFORMATION/BACKGROUND The North South Water Main Phase II Project extends approximately 10,000 linear feet of 36-inch and 42- inch pipeline from the 24-inch line along Roselawn Drive up to the Texas Department of Transportation (TxDOT) facility at the intersection of northbound IH-35E Service Road and Bonnie Brae Road, with the pipeline being within the Bonnie Brae Road right-of-way. This project is on the City’s water masterplan and is needed to provide more adequate and reliable water service to customers. The City entered into a contract with Thalle Construction Company Inc. on January 15, 2019 to complete the North South Phase II Project. Change Order No. 1 totaled $32,140.71 and was approved by Purchasing on March 17, 2020. This change order covered additional message boards, changes due to utility conflicts, and modifications associated with the redesign of the 20” water line. The proposed Change Order No. 2 is comprised of the following: • The original ordinance approved a contract amount of $7,798,807.00. The original contract was eight cents short of the actual bid amount of $7,798,807.08. This Change Order adds the $.08 back to the contract. • 24” Flanged Connection – the size reflected on the plans is different than what was uncovered by Thalle in the field requiring this change. • Recycled asphalt millings placed from Roselawn to Corbin (section open cut for lateral crossing) – no temporary repair measures were allocated in the original bid items. Millings were needed to prevent further degradation of the roadway and provide a safe travelling surface for drivers. • Area of 20” water line lowering; Private Property Access Easement required Water Gap/Breakaway Fencing Improvements (not included in Change Order No. 1) • Tie in a 12-inch main to the 42-inch main, providing 12-inch service for the new Courts at Bonnie Brae Development, preventing an additional lateral line being installed across Bonnie Brae. Performing this work through the North South Phase II contract with Thalle prevents the need to interrupt residents a second time for the work to be performed in the next phase. • 120 additional days accommodate for the boring time required near the railroad. On June 17, 2012, City Council awarded the North-South Water Line Phases II and III design project to Freese and Nichols, Inc., in the not-to-exceed amount of $435,701 (Ordinance 2012-147). There has been a total of five design amendments totaling $616,873.60, for a total contract amount not-to-exceed $1,052,571.60. Amendment 5 allowed a 10% invoice reduction from April 2020 to June 2020. On March 17, 2020, Purchasing approved Change Order No. 1 with Thalle Construction Company, Inc. in the not-to-exceed amount of $32,140.71. On December 14, 2020, this item will be presented to the Public Utilities Board (PUB) for consideration. RECOMMENDATION Award Change Order No. 2 with Thalle Construction Company, Inc., for the construction of the North South Phase II 36-inch/42-inch Water Transmission Line Project for the City of Denton, in the not-to- exceed amount $113,189.27, for a total amended contract amount of $7,944,136.98. PRINCIPAL PLACE OF BUSINESS Thalle Construction Company, Inc. Alvarado, TX ESTIMATED SCHEDULE OF PROJECT This project has an estimated completion date by February 2021. FISCAL INFORMATION These services will be funded from Water Project funds.
