SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager, or his designee, to execute a Professional Services Agreement with Kimley-
Horn and Associates, Inc., for utility conflict analysis, surveying, easement acquisition, design, bidding and
construction administration services in support of the State reimbursable relocation of water and wastewater
utilities within the Interstate Highway 35 Right-of-Way as set forth in the contract; providing for the
expenditure of funds therefor; and providing an effective date (RFQ 6590-095 – Professional Services
Agreement for engineering services awarded to Kimley-Horn and Associates, Inc., in the not-to-exceed
amount of $2,396,300.00).
INFORMATION/BACKGROUND
The Texas Department of Transportation (TxDOT) is currently in the design phase of proposed widening
of Interstate Highway 35 (IH35) from I-35E/I-35W Split to Milam Road and plans to begin construction in
early 2023. As a result of this widening project, the utilities located just outside the existing TxDOT Right-
of-Way (ROW) will have to be relocated. All activities associated with the relocation of the utilities such
as; professional services, easements, construction costs and staff time (effort) are reimbursable by the State.
Within the proposed ROW, the City has a significant water and wastewater infrastructure which has to be
relocated, and the total opinion of probable construction cost for this effort (easement acquisition,
engineering, and City staff time costs) is approximately $28,500,000.
Based on the qualifications, knowledge and experience in designing projects of similar type and magnitude,
staff selected Kimley Horn and Associates, Inc. from a list of qualified consultants to perform this work.
Request for Qualifications for professional engineering services was solicited using the City’s formal
solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018, and
June 5, 2018 (Ordinance 2018-331).
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional
engineering firms (Ordinance 2018-331).
On December 14, 2020, this item will be presented to the Public Utilities Board for recommendation to the
City Council for consideration.

RECOMMENDATION

exceed amount of $2,396,300.

FISCAL INFORMATION
These services will be funded from accounts 630471517, 640444541 and 630471523. Requisition # 149293
has been entered into the Purchasing system in the amount of $2,396,300. The qualifying project costs for
professional services, easements, and construction are fully refundable by the State to the City.
