Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: December 17, 2020 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager, or his designee, to execute a contract with Rehrig Pacific Company, through the U.S. Communities Government Purchasing Alliance Contract #0254, for the purchase of residential refuse, recycling, and yard waste carts and replacement parts; providing for the expenditure of funds therefor; and providing an effective date (File 7536 – awarded to Rehrig Pacific Company, in the five (5) year not-to-exceed amount of $3,862,000.00). INFORMATION/BACKGROUND The proposed contract is for the purchase of residential refuse, recycling, and yard waste carts and replacement parts. The selected vendor Rehrig Pacific Company has been the provider of the City’s residential refuse and recycling carts since 2008, standardizing the wheels, axles, and other parts for the carts. The Solid Waste & Recycling Department purchases refuse, recycling, and yard waste carts due to wear and tear, loss, and residential growth occurring within the City of Denton. Additional carts are needed to serve customers within newly developed areas, and to upsize or downsize existing carts in service. With the onset of the recent pandemic the department has seen an uptick in requests for cart repairs and changes to service levels. Additionally, the Solid Waste Department rolled out a new yard waste service program in October 2019. This program offered customers the opportunity to opt-in to a yard waste cart service. This program has been very successful with about 7,000 customers requesting yard waste carts. These carts and the additional requests related to COVID were unforeseen when the last contract was awarded in January of 2019 and resulted in exhausting the spend on the current contract prematurely. This new contract will have the advantage of better forecasting for the additional yard waste service and anticipated property development in the City. Based on a historical spend and future projections the recommended not to exceed (NTE) for this contract is $3,862,000 for a total potential five (5) year contract. Pricing obtained through the US Communities contract has been competitively bid and meets the statutory requirements of Texas Local Government Code 271.102. City Hall 215 E. Rehrig’s Zero Waste Production Processes ensures scrap resin, packaging, and byproduct can be reused in our manufacturing, including recirculating cooling water and reclaiming hydraulic fluid. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On January 21, 2003, Council approved the interlocal agreement with the US Communities Cooperative Purchasing Network (Ordinance 2003-017). On December 14, 2020, this item will be presented to the Public Utilities Board (PUB) for consideration. RECOMMENDATION Award a contract with Rehrig Pacific Company, for the purchase of residential refuse, recycling, and yard waste carts and replacement parts, in a five (5) year not-to-exceed amount of $3,862,000. FISCAL INFORMATION These items will be funded from Solid Waste Operating Funds. The City will only pay for services rendered and is not obligated to pay the full contract amount unless needed.
