SUBJECT
Consider adoption of an ordinance of the City of Denton, Texas, a Texas home-rule municipal
corporation, authorizing the City Manager to execute a Professional Services Agreement with
Kimley-Horn and Associates, Inc. for an Americans with Disabilities (ADA) Act Compliance
Review and Transition Plan as set forth in the agreement; providing for the expenditure of funds
therefor; and providing an effective date (RFQ 6590-033 - Professional Services Agreement for
Design Services awarded to Kimley-Horn and Associates Inc., in the not-to-exceed amount of
$239,850).
FILE INFORMATION /BACKGROUND
The City of Denton is committed to city-wide American’s with Disabilities (ADA) Act
compliance, this project will review sidewalks and signalized intersections across the city.
Kimley-Horn and Associates, Inc. is an engineering and planning firm with expertise in ADA
compliance. The consultant will survey the sidewalk infrastructure and signalized intersections
throughout the city to review their condition with respect to compliance with ADA requirements.
The consultant will conduct an evaluation of the existing infrastructure and develop an ADA
Transition Plan in Multiple phases. This Professional Services Agreement will allow the
consultant to complete Phase 1 of the ADA Self-Evaluation and Transition Plan and will include
an ADA compliance review of city-owned signalized intersections, public rights-of-way,
sidewalks, and associated curb ramps. The consultant will furnish potential solutions to bring
non-compliant infrastructure elements (that are not considered to be a de minimis barrier and are
not “safe harbored”) into compliance. The data collected, proposed improvements required, and
the cost associated with these improvements will be compiled into the ADA Transition Plan
document.
The ADA transition plan will be developed to include formal documentation of tasks and
associated findings outlined in the scope of services. The funding for developing an ADA
Transition Plan was approved as part of the FY 16-17 City Budget. In the last couple of years,
Capital Projects staff has identified a consultant eligible to perform the work and prepared a
framework of the Transition Plan document that will be populated with this additional data. This

phase will gather data, perform an assessment of that data, and develop cost estimates to bring
the City’s infrastructure up to ADA compliance.
Request for Qualifications for professional engineering services was solicited using the City’s
formal solicitation process. City Council approved a pre-qualified list of engineering firms on
March 6, 2018, and June 5, 2018 (Ordinance 2018-331).
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of
professional engineering firms (Ordinance 18-331).
RECOMMENDATION
Award a contract with Kimley-Horn and Associates Inc., for professional services to produce an
Americans with Disabilities (ADA) Act Compliance Transition Plan in the not-to-exceed amount
of $239,850.

FISCAL INFORMATION
These services will be funded from the General Fund account under two separate accounts-
250049444 ($205,000) and 250074444 ($34,843.32). Requisition #139357 has been entered into
the Purchasing software system in the amount of $239,843.32. The budgeted amount for this
service is $239,850.
An estimated cost summary for the Professional Services Agreement (PSA) is detailed below:
Project Management and Overhead: $38,850
Signalized Intersection Review: $55,000
Sidewalk and Curb Ramp Review: $146,000

STRATEGIC PLAN RELATIONSHIP
The City of Denton’s Strategic Plan is an action-oriented road map that will help the City
achieve its vision. The foundation for the plan is the five long-term Key Focus Areas (KFA):
Organizational Excellence; Public Infrastructure; Economic Development; Safe, Livable, and
Family-Friendly Community; and Sustainability and Environmental Stewardship. While
individual items may support multiple KFAs, this specific City Council agenda item contributes
