SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a Professional Services Agreement between the City of
Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on
September 18, 2018, in the not-to-exceed amount of $239,850.00; said first amendment to continue to
provide an Americans with Disabilities (ADA) Act Compliance Review and Transition Plan; providing for
the expenditure of funds therefor; and providing an effective date (RFQ 6590-033 – providing for an
additional first amendment expenditure amount not-to-exceed $338,000.00, with the total contract amount
not-to-exceed $577,850.00).
INFORMATION/BACKGROUND
The City of Denton is committed to city-wide American’s with Disabilities (ADA) Act compliance. During
Phase I, Kimley Horn conducted an evaluation of the existing infrastructure and began development of an
ADA Transition Plan document which will be divided into multiple phases. The consultant also provided
potential solutions to bring non-compliant infrastructure elements (that are not considered to be a de
minimis barrier and are not “safe harbored”) into compliance.
Facilities Management is proposing a contract amendment for Phase II and III of the ADA Transition Plan.
These phases will review all City buildings and associated park properties. This analysis will include but is
not limited to, parking lots, sidewalks, curb ramps, paved and unpaved pedestrian trails, pedestrian bridges,
and various park amenities throughout the City to assess their condition with respect to compliance with
ADA requirements.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional
engineering firms (Ordinance 2018-331).
On September 18, 2018, City Council approved a contract with Kimley-Horn and Associates, Inc., in the
not-to-exceed amount of $239,850 (Ordinance 18-1431).

RECOMMENDATION
Award Amendment No. 1 with Kimley-Horn and Associates, Inc., to continue to provide an Americans
with Disabilities (ADA) Act Compliance Transition Plan, in the not-to-exceed amount $338,000, for a total
amended contract amount of $577,850.
