Exhibit 1 - Agenda Information Sheet - Amendment 3City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: January 12, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a third amendment to the Professional Services Agreement between the City of Denton and Halff Associates, Inc., amending the contract approved by City Council on November 6, 2018, in the not-to-exceed amount of $837,900.00; Amendments 1 and 2 were approved by Purchasing staff; said third amendment to provide additional surveying and engineering services is necessary for the design of the water mains, sanitary sewers, storm sewers, and culverts in Elm Street and Locust Street, and a drainage study of North Pecan Creek and Pecan Creek; providing for the expenditure of funds therefor; and providing an effective date (File 6590-041 - providing for an additional third amendment expenditure amount not-to- exceed $177,840.00, with the total contract amount not-to-exceed $1,056,040.00). INFORMATION/BACKGROUND Locust Street and Elm Street are both currently Texas Department of Transportation (TxDOT) roadways. The Locust Street and Elm Street Water, Wastewater and Drainage Improvements Project was conceived in order to replace aging infrastructure along Elm and Locust Streets prior to TxDOT resurfacing and ultimately turning ownership of these streets over to the City of Denton. The water mains and sanitary sewer improvements for this project will occur between West University Drive to the north and Hickory Street to the south. Phase I of the storm drain improvements are to determine the flow and culvert design for Elm Street and Locust Street crossings of North Pecan Creek and Pecan Creek. Phase II of the storm drain improvements include the completion of the detailed watershed study for North Pecan Creek and Pecan Creek. The detailed watershed study will facilitate future design and sizing of crossing structures throughout the watershed. The purpose of this amendment is to provide funding to address drainage revisions and comments found during the 90% review process. The amendment will also fund TxDOT permit coordination along with right-of-way acquisition assistance. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional engineering firms (Ordinance 2018-331). On November 6, 2018, City Council approved a Professional Engineering Services Agreement with Halff Associates, Inc., in the not-to-exceed amount of $837,900 (Ordinance 18-1662). City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com On June 19, 2019, Purchasing approved Amendment 1 with Halff Associates, Inc. to include Austin Street Utilities (Water and Sanitary Sewer) on the Locust Street and Elm Street Water, Wastewater and Drainage Improvement Project, in the not-to-exceed amount of $40,300. On May 13, 2020, Purchasing approved Amendment 2 with Halff Associates, Inc. to allow a 5% billing rates reduction from April to June 2020. On January 11, 2021, this item will be presented to the Public Utilities Board (PUB) for consideration. RECOMMENDATION Award Amendment No. 3 with Halff Associates, Inc., to provide additional surveying and engineering services is necessary for the design of the water mains, sanitary sewers, storm sewers and culverts in Elm Street and Locust Street and a drainage study of North Pecan Creek and Pecan Creek, in the not-to-exceed amount of $177,840, for a total amended contract amount of $1,056,040.
