AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNicmAL
CORPORATION, AUTHORIZING THE APPROVAL OF A THIRD AMENDMENT TO A
CONTRACT BETWEEN THE CITY OF DENTON AND USIC LOCATnqG SERVICES, LLC,
AMENDING THE CONTRACT APPROVED BY CITY COUNCEL ON JUNE 19, 2018, IN THE
NOT-TO-EXCEED AMOUNT OF $1,200,000.00; AMENDED BY AMENDMENTS 1-2
APPROVED BY PURCHASING; SAm THURD AMENDMENT TO CONTHqUE TO SUPPLY
UNDERGROUND UTILITY LOCATING SERVICES; PROVIDUqG FOR THE EXPENDITURE
OF FUNDS THEREFOR; AND PROVDING AN EFFECTIVE DATE (FILE 6736 – PROVDHqG
FOR AN ADDITIONALTHRD AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED
§300,000.00, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $1,500,000.00).
WHEREAS, on June 19, 2018, by Ordinance No. 18-938, the City awarded a contract to
USIC Locating Services, LLC in the amount of $ 1,200,000.00 to supply underground utility locating
services; and
WHEREAS, on June 6, 2019, Purchasing approved Amendment No. 1 to USIC Locating
Services, LLC, to accept updated pricing; and
WHEREAS, on June 16, 2020, Purchasing approved Amendment No. 2 to USIC Locating
Services, LLC, to accept updated pricing; and
WHEREAS, the additional fees under the proposed Third Amendment are fair and reasonable
and are consistent with and not higher than the recommended practices and fees applicable to the
Provider’s profession and such fees do not exceed the maximum provided by law; NOW,
THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDARqS:
SECTION 1. The Third Amendment, increasing the amount of the contract between the City
and USIC Locating Services, LLC, which is on file in the office of the Purchasing Agent, in the
amount of Three Hundred Thousand and 00/ 100 ($300,000.00) Dollars, is hereby approved and the
expenditure of funds therefor is hereby authorized in accordance with said amendment. The total
contract amount increases to $1,500,000.00.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
