SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager, or his designee, to execute a contract with Hammett Excavation, Inc., for the
excavation and construction of Cells 4B-C-D at the City of Denton Landfill; providing for the expenditure
of funds therefor; and providing an effective date (RFP 7540 – awarded to Hammett Excavation, Inc., in
the not-to-exceed amount of $3,247,974.84). The Public Utilities Board recommends approval (5 - 0).
INFORMATION/BACKGROUND
The current Landfill cell the Solid Waste & Recycling Department is utilizing for disposal contains
approximately 2.1M – 2.23M cubic yards. It’s forecasted to contain approximately 1.83M cubic yards by
November 2020, approximately 90% - 100% full. The new cell planned for construction, Cell 4B-C-D is
approximately 23 acres and is located east of Cells 3, and north of Cell 4-A, generally in the center area of
the Landfill. The construction will be excavated to an elevation of approximately 570 feet above sea level
at the north end and decreasing to approximately 562 feet above sea level at the southern end. The total
projected excavated quantity will be approximately 500,000 cubic yards which will be stored on site.
Available airspace for disposal will be approximately 2.0 – 2.5M cubic yards, based on the final elevation
determined per the ongoing permit amendment.
The Solid Waste Department’s capital improvement program (CIP) provides funding for the excavation and
construction of this project. The City and the engineering firm of Parkhill, Smith, and Cooper (PSC)
completed a professional services agreement in August 2020 to provide services related to the design,
construction, and regulatory approval.
Construction cost proposals were received from five qualified vendors and their unit pricing for the work
is provided in Exhibit 2. Construction costs range from $3.24M – to $5.10M. The evaluation committee
scored the proposals, requesting a best and final offer (BAFO) from the top evaluated company. Following
the BAFO review, the evaluating committee recommended Hammett Excavation as providing the best
services for the City.
Requests for Proposals was sent to 426 prospective suppliers of this item. In addition, specifications were
placed on the Materials Management website for prospective suppliers to download and advertised in the
local newspaper. Five (5) proposals were received and evaluated based upon published criteria including

past performance, experience and qualifications of key personnel, probable performance, and price. Based
upon this evaluation, Hammett Excavation, Inc. was ranked the highest and determined to be the best value
for the City.

On February 8, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award a contract with Hammett Excavation, Inc., for the excavation and construction of Cells 4B-C-D at
the City of Denton Landfill, in the not-to-exceed amount of $3,247,974.84.
