Exhibit 1 - Agenda Information SheetCity of Denton ______________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: February 23, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager, or her designee, to execute a contract with Jagoe-Public Company, for the construction of the Lake Forest Park Pond and Dam Rehab project for the Parks and Recreation Department; providing for the expenditure of funds therefor; and providing an effective date (IFB 7518 – awarded to Jagoe-Public Company, in the not-to-exceed amount of $3,021,706.94). INFORMATION/BACKGROUND Lake Forest Park is a 69.32-acre park that includes a lake, playground equipment, trails, green open space, and is also home to Wiggly Field Dog Park. Lake Forest Park pond, located on the west side of the park, is approximately 10 acres. This body of water serves not only as drainage retention but also as a water recreation feature for the surrounding park and the Good Samaritan Society – Lake Forest Village. According to a Texas Commission on Environmental Quality (TCEQ) dam inspection report received on December 9, 2008, the pond and dam were originally constructed by previous owners in 1935. The dam failed in the 1950s and was rebuilt in 1965. TCEQ classifies this dam as a small dam with a low hazard classification. The City of Denton has owned the park land since December 2002 and have made many improvements over the years. In addition, the inspection report noted that the dam was in poor condition. The Parks and Recreation Department (PARD) hired CP&Y to conduct a hydraulic study and dam breach analysis in 2011. Subsequently, Kimley-Horn and Associates, Inc. was hired to prepare a floodplain study and hydrologic analysis of the stream and pond. In 2014, a request through the bond program of $1,085,000 was made but was not granted funding. October of 2017, Teague Nall and Perkins (TNP) was contracted to conduct a current assessment evaluation of the dam and complete a Hydrologic and Hydraulic (H&H) evaluation of existing conditions. Through this study, TNP determined that the dam and outlet configuration does not meet the current City of Denton design criteria, and improvements are necessary. Also, the current H&H evaluations indicate a lack of hydraulic capacity through the dam. The report indicates that dam and outlet improvements are necessary. On February 26, 2019, City Council approved the Engineering Services for Lake Forest Pond and Dam to O’Brien’s Engineering Services to include; Topographic Survey, Bathymetry Survey, Geotechnical Engineering Data Collection, GIS Data, 404 Permitting (Water of the US delineation), Dam Safety City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com Permitting, Water Rights needs assessment, Hydrologic and Hydraulic Analysis, and Design, Dam Breach Mapping and EAP, Dam Rehab Design, Dredging Evaluation (Dredging Plans and Specifications), Operation and Maintenance Plan, and Construction Administration. This process was completed in August 2020. The outcome of the engineers' plan covers construction documents, cost estimates of construction, financial considerations, project scheduling, 404 permitting (permit through EPA for the discharge of dredged material), water rights through TCEQ, dam breach mapping, and an Emergency Action Plan (EAP), dam rehabilitation design, dredging plan, operations, and maintenance plan, and construction administration through the construction phase. Over the past year, the Parks and Recreation Department has developed a line of communication with the residents of the Good Samaritan Society – Lake Forest Village. Park Maintenance keeps in contact with the residents through Mr. Freddie Martinez, Executive Director - Good Samaritan Society Denton, and with Mrs. LaVona Duryea – Good Samaritan Society – Lake Forest Village Lake Committee. Communications include emails, phone calls, site visits, and monthly “Facts with Freddie” meetings. Since last fall, Park Maintenance has cleared brush downstream of the spillway, cleared aquatic vegetation in and around the lake, conducted surveillance of the spillway to prevent blockages, and met with Texas Parks and Wildlife for an aquatic wildlife analysis. Parks Maintenance obtained quotes for aquatic vegetation maintenance for all six ponds within the Park system and received $40,000 as ongoing funding starting the Fiscal Year 2019-2020 budget. This regular maintenance includes maintaining adequate vegetation to sustain wildlife and water quality. The project total cost of $3,021,706.94 for the Lake Forest Pond and Dam Rehab consists of: $2,747,006.31 total base bid; and a $274,700.63 contingency. A ten (10) percent contingency allowance, if any, is for the sole use of the City and will be subject to written authorization by the City’s Parks and Recreation Director. Invitation for Bids was sent to 668 prospective suppliers of this item, including 56 Denton firms. In addition, specifications were placed on the Materials Management website for prospective suppliers to download and advertised in the local newspaper. Five (5) bids meeting specifications were received. The lowest bid was submitted by Jagoe-Public Company.
