Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: March 16, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager, or their designee, to execute a Professional Services Agreement with Freese and Nichols, Inc., for engineering-related on-call professional services, as set forth in the contract; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6590-100 – Professional Services Agreement for engineering on-call services awarded to Freese and Nichols, Inc., in the three (3) year not-to-exceed amount of $3,031,783.00). The Public Utilities Board recommends approval (6 - 0). INFORMATION/BACKGROUND Freese and Nichols, Inc. is one of the qualified firms that submitted for the Project Management category and has been selected for the On-Call Professional Services project. Freese and Nichols was also determined to be qualified in all other categories including the design of water, wastewater, storm water, roadway, and traffic signal infrastructure. The objective of this project is to provide professional services to supplement the capacity of the Water/Wastewater Department. Given the rate at which new developments are moving into the City of Denton, the capacity expansion of the utilities has to support this fast-paced growth. As such, there are several water and wastewater infrastructure projects that need to be completed in the next two to three years. This contract will help supplement/augment City staff to complete these critical utility infrastructure projects in a timely manner. The proposed engineering contract for this project will be on an hourly basis with a not-to-exceed amount of $3,031,783. Scope of services will include: • Staff Augmentation • Project Management • Construction Management The work will be performed on an as-needed basis when specifically requested by the City of Denton with an official Work Authorization request. Each Work Authorization will include a scope of services defining the tasks required to complete the Work Authorization. For each task, the scope shall include a detailed description of the task, outline any City Hall 215 E. Future Work Authorizations will not be brought before PUB or City Council until the total contract capacity has been depleted. Work Authorization No. 1: I-35E/Mayhill Road Utility Relocation: $255,648.20 The scope of this Work Authorization includes project and construction management services for the TxDOT I-35E Utility Relocations between Loop 288 and Post Oak Drive. The project includes the relocation of water and wastewater lines along the I-35E corridor on the south side of the City. Work Authorization No. 2: Northwest Booster Pump Station and Transmission Main: $604,816.70 The scope of this Work Authorization includes project management services during the design phase and construction management throughout the construction of the Northwest Booster Pump Station and Transmission Main project. Request for Qualifications for professional engineering services was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018 and June 5, 2018 (Ordinance 2018-331). PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional engineering firms (Ordinance 2018-331). On March 8, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award a contract with Freese and Nichols, Inc., for engineering-related on-call professional services, in a three (3) year not-to-exceed amount of $3,031,783. PRINCIPAL PLACE OF BUSINESS Freese and Nichols, Inc. Fort Worth, TX ESTIMATED SCHEDULE OF PROJECT This is a three (3) year contract. FISCAL INFORMATION Work Authorization No. 1 and 2 are funded by Water and Wastewater Project Funds. Requisitions and purchase orders for these Work Authorizations will be processed after approval of this contract. The additional contract capacity of $2,171,317 will be utilized over the next three years as needed.
