WHEREAS, the City deems it necessary to further expand the services provided by Consultant to the City pursuant to the terms of the Agreement, and to provide an additional not-to-exceed amount $9,650 with this Amendment for an aggregate not-to-exceed amount of $79,295; and FURTHERMORE, the City deems it necessary to further expand the goods/services provided by Engineer to the City; NOW THEREFORE, the City and Engineer (hereafter collectively referred to as the “Parties”), in consideration of their mutual promises and covenants, as well as for other good and valuable considerations, do hereby AGREE to the following Amendment, which amends the following terms and conditions of the said Agreement, to wit: 1. The additional services described in Exhibit “A” of this Amendment, attached hereto and incorporated herein for all purposes, for professional services related to the Hickory Creek Interceptor, Phases I and II, are hereby authorized to be performed by Engineer. For and in consideration of the additional services to be performed by Engineer, the City agrees to pay, based on the cost estimate detail attached as Exhibit “A”, a total fee, including reimbursement for non-labor expenses an amount not to exceed $9,650. 2. This Amendment modifies the Agreement amount to provide an additional $9,650 for the additional services with a revised aggregate not to exceed total of $79,295. The Parties hereto agree, that except as specifically provided for by this Amendment, that all of the terms, covenants, conditions, agreements, rights, responsibilities, and obligations of the Parties, set forth in the Agreement remain in full force and effect. This change order request includes a detailed summary of the additional services provided during the performance of the subject work as requested by the City that were not included in our initial scope of services dated July 6, 2020. These additional services were performed on a time-and- material basis consistent with our fee schedule included in our July 6, 2020 scope of services. As such, we have provided a detailed summary and fee breakdown of these additional services below corresponding each task included in our initial scope of services and approved PO#194020: Task 1 – Conceptual Layout and Project Planning Meeting Additional services performed in this task was primarily associated with SCS attending project meetings, phone calls, and email correspondence between the City of Denton’s Development Services (DS) and Solid Waste & Recycling Division (City) over a 2 month period. Specifically, this work included the following:  Researching historical permit documents and FEMA database for 100-year floodplain limits to address questions related to impact of proposed roadway to the floodplain, as requested by DS,  Drainage and downstream assessment – Time was spent by SCS to address questions pertaining to drainage and downstream assessment, as requested by DS. SCS researched the facility wide drainage analysis, submitted by Parkhill Smith & Cooper (PSC) with pending permit application 1590B, and compared the analysis with the City of Denton’s Stormwater Design Manual referenced by the DS. In an effort to expedite the approval of the project by DS, a draft written response to DS’ questions was prepared, as requested by the City; however, this written response was never finalized or submitted once we were informed that DS was no longer involved in the review process for this project.  Traffic Impact Assessment (TIA) – Time was spent by SCS to prepare a TIA in response to questions by DS, as requested by the City. SCS worked to expedite this item as requested by the City prior to being informed that this was no longer required and that DS was no longer involved in the review process for this project. These tests were performed to establish a benchmark for use during construction and enable the CQA consultant to confirm that the recommended amount of lime has been added to the soil. SCS performed a hydrologic evaluation and hydraulic calculations to size the ditch to convey the peak flow rate for a 10 year, 24-hour storm event and discharge to existing stormwater management system via corrugated metal pipe pipes (CMP) at regular intervals. Multiple grading iterations of the road and ditch were required to fit the ditch within the limited space available between the limits of waste and proposed road. Additionally, two (2) details were required to be included for each CMP proposed at discharge locations.  Leachate force main pipe – SCS added an extension to the leachate forcemain between existing Cell 5 and future Cell 6 to the construction plans and technical specifications. This task required a background review of survey information to locate tie-in of existing force main pipe at Cell 5 and include necessary design information for the forcemain extension as well as abandonment of an existing undersized line currently in use on multiple construction plans, technical specifications, and engineer’s opinion of probable construction cost estimate (EOCC).  24 inch landfill gas header – SCS included design information of a 24 inch landfill gas header for tie-in to a future landfill gas energy facility within the construction plans, technical specifications, and EOCC. This effort SCS to design this header stub-out to traverse an existing drainage channel to accommodate future sump placement and tie-in, including pipe protection below the drainage ditch.  Retrofitting leachate collection risers at Cell 5 for gas collection – SCS prepared an additional construction detail to depict the collection of landfill gas from an existing 6-inch leachate cleanout riser and 18-inch leachate sump riser at Cell 5. This information was included in construction plans, technical specifications, and EOCC.
