SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager, or their designee, to execute a contract with Hammett Excavation, Inc., for
the construction of the Public Disposal Facility for the Solid Waste & Recycling Department; providing for
the expenditure of funds therefor; and providing an effective date (CSP 7568 – awarded to Hammett
Excavation, Inc., in the not-to-exceed amount $2,526,832.34). The Public Utilities Board recommends
approval (5 - 0).
INFORMATION/BACKGROUND
The Solid Waste & Recycling Department operates the Public Disposal Facility (PDF) at the City of Denton
Landfill. In the Municipal Solid Waste Permit #1590(A) a Recyclables Collection and Storage Area as well
as a Citizen Collection Area is detailed. The purpose of this operation is to separate and isolate public
customers from commercial customers and the landfill working face to reduce potential dangers of mixing
waste collection vehicles, landfill heavy equipment, and auxiliary landfill/construction heavy equipment
with PDF customers.
The current temporary PDF is located within the footprint of the next landfill cell which is currently under
construction and is due to be completed in December 2021. Arrangements have been made to relocate the
PDF to another temporary location until the new facility is completed.
The purpose of the contract is to allow the Solid Waste & Recycling Department to secure a contract with
a construction firm to build the professional engineer-designed facility to accommodate the public,
including residents and contractors, to dispose of construction and demolition material as well as property
maintenance and cleanup. The PDF will include a designated area for recycling of electronics and
appliances; including an area for the public to dispose of recyclable materials.

Competitive Sealed Proposals were sent to 461 prospective suppliers. In addition, specifications were
placed on the Materials Management website for prospective suppliers to download and advertised in the
local newspaper. Seven (7) proposals were received, with four (4) meeting specifications, references were
checked, and proposals were evaluated based upon published criteria including past performance,

experience, probable performance, and price. Best and Final Offers (BAFO) were requested from the top
firm. Based upon this evaluation, Hammett Excavation, Inc. was ranked the highest and determined to be
the best value for the City.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On June 14, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award a contract with Hammett Excavation, Inc., for the construction of the Public Disposal Facility for
the Solid Waste & Recycling Department, in the not-to-exceed amount of $2,526,832.34.
SUSTAINABILITY MEASURES
The PDF will continue to assist with the diversion of discarded materials ending up in the landfill. This
action will help with the reduction of greenhouse gas emissions, reducing public health issues. Diverting
materials will reduce the use of valuable landfill air space as well as giving the discarded material another
opportunity to serve a different purpose.
