ORDINANCE NO.
AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF CHANGE ORDER NO. 1 TO THE
CONTRACT BETWEEN THE CITY OF DENTON AND FIAMMETr EXCAVATION, INC., FOR
THE EXCAVATION AND CONSTRUCTION OF CELL 4 AT THE CITY OF DENTON
LANDFILL; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND
PROVIDING AN EFFECTIVE DATE (IFB 7540 – CHANGE ORDER NO. 1 1N THE NOT-TO-
EXCEED AMOUNT OF $72,606.50, FOR A TOTAL CONTRACT AWARD AGGREGATED TO
$3,320,581.34).
WHEREAS, on February 23, 2021, by Ordinance No. 21-233, the Council awarded a
contract to Hammett Excavation, Inc. in the amount of $3,247,974.84, for the excavation and
construction of Cell 4 at the City of Denton Landfill; and
WHEREAS, Staff and the City Manager recommend to the Council that a change order be
authorized to amend such contract agreement with respect to the scope of work and a decrease in the
payment amount; NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. Change Order No. 1, increasing the amount of the contract between the City
and Hammett Excavation, Inc., which is on file in the office of the Purchasing Agent, in the amount
of Seventy-Two Thousand Six Hundred Six and 50/100 ($72,606.50) dollars, is hereby approved,
and the expenditure of funds therefore is hereby authorized in accordance with said change order.
The total purchase order amount increases to $3,320,581.34.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
