AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF THE SECOND AMENDMENT TO A
CONTRACT BETWEEN THE CITY OF DENTON AND GRACE LUCE RAIN, INC.,
AMENDING THE CONTRACT APPROVED BY CITY COUNCEL ON DECEMBER 17, 2020 IN
THE NOT-TO-EXCEED AMOUNT OF $292,993.00, FOR THE EMERGENCY SOLUTIONS
GRANT CARES ACT (ESG-CV), SAD SECOND AMENDMENT TO EXTEND THE TERM OF
THE CONTRACT TO OCTOBER 3 1, 2021 ; PROVDHqG FOR THE EXPENDITURE OF FUNDS
THEREFOR; AND PROViDING AN EFFECTIVE DATE (RFQ 7525-o03 – PROVDING FORA
REDUCTION SECOND AMENDMENT AMOUNT NOT-TO-EXCEED $3,209.75, WITH A
TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $101,688.16 AND EXTENDING THE
CONTRACT WITH GRACE LIKE RAIN, INC. TO OCTOBER 3 1, 2021).
WHEREAS, on December 17, 2020, by Ordinance No. 20-2454, the City awarded a contract
to Grace Like Rain, Inc. in the amount of $292,993.00, for allocation of funding for the Emergency
Solutions Grant CARES Act (ESG-CV); and
WHEREAS, on May 4, 2021, by Ordinance No. 21-795, the City awarded a First
Amendment to Grace Like Rain, Inc. in the amount of $104,897.91, for a reduction of fees for the
allocation of funding for the Emergency Solutions Grant CARES Act (ESG-CV); and
WHEREAS, the additional fees under the proposed Second Amendment are fair and
reasonable and are consistent with, and not higher than, the recommended practices and fees
applicable to the Provider’s profession, and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAPqS:
SECTION 1. The Second Amendment, reducing the amount of the contract between the City
and Grace Like Rain, Inc., which is on file in the office of the Purchasing Agent, in the amount of
Three Thousand Two Hundred Nine and 75/100 ($3,209.75) Dollars, is hereby approved, and the
expenditure of funds therefor is hereby authorized in accordance with said amendment which shall
be effective upon the execution of the amendment attached hereto. The total contract amount
decreases to $101,688.16.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
