Exhibit 1 - Agenda Information Sheet Amendment 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: August 3, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a Professional Services Agreement between the City of Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on January 14, 2020, in the not-to-exceed amount of $922,800.00; amended by Amendment 1 approved by City Council; said second amendment to provide utility conflict analysis, surveying, easement acquisition, design, bidding, and construction administration services in support of the State reimbursable relocation of water and wastewater utilities within the Interstate Highway 35E Right-of-Way; providing for the expenditure of funds therefor; and providing an effective date (File 6590-084 – providing for an additional second amendment expenditure amount not-to-exceed $217,500.00, with the total contract amount not-to- exceed $1,305,300.00). The Public Utilities Board recommends approval (7 - 0). INFORMATION/BACKGROUND The Texas Department of Transportation (TxDOT) has provided the City of Denton with a Notice of Proposed Construction for Interstate Highway 35E (IH35E) between Loop 288 and Pockrus Page Road. Therefore, all qualifying professional services, easements, and construction costs are reimbursable by the State. TxDOT is in the process of acquiring right-of-way (ROW) for the I-35E widening project and is scheduled to wrap up this phase by December 2021. The TxDOT project anticipates that it will require approximately 18 months for all utilities along this segment of I-35E to be relocated. As such, the anticipated let (bid) date for construction is June 2022. TxDOT requests that all City infrastructure is relocated out of the proposed ROW prior to this date. Currently, the City’s relocation is expected to be completed by the end of December 2022 and the total cost of the utility relocation project is approximately $10,800,000. Recently TxDOT notified the City of Denton of a redesigned portion of the roadway project that necessitates an additional waterline location. This additional relocation effort is expected to increase the water line relocation project by $1,719,148 with anticipating $1,654,078 of this effort will be reimbursable. Based on the qualifications, knowledge, and experience in designing projects of similar type and magnitude, staff selected Kimley-Horn and Associates, Inc. from a list of qualified consultants to perform this work. The original scope of services included preparing design, ROW support services, and construction support services with a total contract amount of $922,800. Subsequently, the contract was amended on January 12, 2021 (Ordinance 21-0109) for an additional $165,000 bringing the contract to a total not-to-exceed amount of $1,087,800.00. City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com When the original scope was developed for the design contract, it was anticipated that ROW services for approximately 25 parcels would be required, with the second amendment adding an additional ten (10) parcels. Following the TxDOT notification to the City of Denton of their redesign of the project, an additional eight (8) parcels will be added, including the replacement of an additional 1,691 linear feet of water line. The proposed amendment to the existing contract will allow Kimley-Horn and Associates, Inc. to provide property negotiation services, title closing services, and appraisal services for ten (10) additional parcels. Request for Qualifications for professional engineering services was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018, and June 5, 2018 (Ordinance 2018-331). PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional engineering firms (Ordinance 2018-331). On January 14, 2020, City Council approved a contract with Kimley-Horn and Associates, Inc., in the not- to-exceed amount of $922,800 (Ordinance 20-040). On January 12, 2021, City Council approved a first amendment with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $165,000 (Ordinance 21-019). On July 26, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award Amendment No. 2 with Kimley-Horn and Associates, Inc., to provide utility conflict analysis, surveying, easement acquisition, design, bidding, and construction administration services in support of the State reimbursable relocation of water and wastewater utilities within the Interstate Highway 35E Right-of- Way, in a not-to-exceed amount $217,500, for a total amended contract amount of $1,305,300.
