21-2172 - 7525-002 - Amendment 3 Ordinance Executed21-2172 ORDINANCE NO. _ AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME -RULE MUNICIPAL CORPORATION, AUTHORIZING THE APPROVAL OF THE THIRD AMENDMENT TO A CONTRACT BETWEEN THE CITY OF DENTON AND GIVING HOPE, INC., AMENDING THE CONTRACT APPROVED BY CITY COUNCIL ON DECEMBER 17, 2020, IN THE NOT - TO -EXCEED AMOUNT OF $277,616.00; AMENDED BY AMENDMENTS 1-2 APPROVED BY CITY COUNCIL; SAID THIRD AMENDMENT TO EXTEND THE TERM OF THE CONTRACT TO JANUARY 31, 2022; AND PROVIDING AN EFFECTIVE DATE (RFQ 7525-002 — EXTENDING A CONTRACT WITH GIVING HOPE, INC. TO JANUARY 31, 2022). WHEREAS, on December 17, 2020, by Ordinance No. 20-2453, the City awarded a contract to Giving Hope, Inc. in the amount of $277,616.00, for allocation of funding for the Emergency Solutions Grant CARES Act (ESG-CV); and WHEREAS, on May 4, 2021, by Ordinance No. 21-794, the City awarded a First Amendment to Giving Hope, Inc. in the amount of $158,701.00, to reduce the allocation offunding for the Emergency Solutions Grant CARES Act (ESG-CV); and WHEREAS, on July 20, 2021, by Ordinance No. 21-1372, the City awarded a Second Amendment to extend the contract awarded by Council to October 31, 2021 for the Emergency Solutions Grant CARES Act (ESG-CV); and WHEREAS, the additional fees under the proposed Third Amendment are fair and reasonable and are consistent with, and not higher than, the recommended practices and fees applicable to the Provider's profession, and such fees do not exceed the maximum provided by law; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The findings and recitations contained in the preamble of this ordinance are incorporated herein by reference. SECTION 2. The authority to receive additional Emergency Solutions Grant CARES Act ESG-CV) services from Giving Hope, Inc., authorized by Ordinance 20-2453, is hereby extended under File 7525-002 until January 31, 2022 by the execution of the amendment attached hereto. SECTION 3. The City Council delegates the authority to the City Manager, or their designee, to take any actions that may be required or permitted to be performed by the City of Denton under File 7525-002 to the City Manager of the City of Denton, Texas, or their designee. SECTION 4: This ordinance shall become effective immediately upon its passage and approval.
