ORDINANCE NO.
AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME -RULE MUNICIPAL
CORPORATION, AUTHORIZING THE APPROVAL OF THE SECOND AMENDMENT TO A
CONTRACT BETWEEN THE CITY OF DENTON AND THE SALVATION ARMY-DENTON,
AMENDING THE CONTRACT APPROVED BY CITY COUNCIL ON DECEMBER 17, 2020, IN
THE NOT -TO -EXCEED AMOUNT OF $656,465.00; AMENDED BY AMENDMENT 1
APPROVED BY CITY COUNCIL; SAID SECOND AMENDMENT TO EXTEND THE TERM
OF THE CONTRACT TO JANUARY 31,2022; AND PROVIDING AN EFFECTIVE DATE (RFQ
7525-004 - EXTENDING A CONTRACT WITH THE SALVATION ARMY-DENTON TO
JANUARY 31, 2022).
WHEREAS, on December 17, 2020, by Ordinance No. 20-2455, the City awarded a contract
to The Salvation Army - Denton, in the amount of $656,465.00 for allocation of funding for the
Emergency Solutions Grant CARES Act (ESG-CV); and
WHEREAS, on July 20, 2021, by Ordinance No. 21-1375, the City awarded a First
Amendment to The Salvation Army - Denton in the amount of $59,893.00, for allocation of funding
for the Emergency Solutions Grant CARES Act (ESG-CV) and extension of the contract; and
WHEREAS, the additional fees under the proposed Second Amendment are fair and
reasonable and are consistent with, and not higher than, the recommended practices and fees
applicable to the Provider's profession and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The findings and recitations contained in the preamble of this ordinance are
incorporated herein by reference.
SECTION 2. The authority to receive additional Emergency Solutions Grant CARES Act
ESG-CV) services from The Salvation Army - Denton, authorized by Ordinance 20-2455, is hereby
extended under File 7525-004 until January 31, 2022 by the execution of the amendment attached
hereto.
SECTION 3. The City Council delegates the authority to the City Manager, or their
designee, to take any actions that may be required or permitted to be performed by the City of
Denton under File 7525-004 to the City Manager ofthe City ofDenton, Texas, or their designee.
SECTION 4: This ordinance shall become effective immediately upon its passage and
approval.
