Exhibit 1 - Agenda Information Sheet - Amendment 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: November 16, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a Professional Services Agreement between the City of Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on January 14, 2020, in the not-to-exceed amount of $1,398,600.00; amended by Amendment 1 approved by the City Council; said second amendment to provide additional design engineer services and hydraulic analysis in support of the Northwest Booster Pump Station and Water Transmission Main project; providing for the expenditure of funds therefor; and providing an effective date (File 6590-081 – providing for an additional second amendment expenditure amount not-to-exceed $248,500.00, with the total contract amount not-to- exceed $1,773,400.00). The Public Utilities Board recommends approval (6 - 0). INFORMATION/BACKGROUND The installation of a new Booster Pump Station and the associated Water Transmission Main are part of the overall Water Distribution Master Plan. The Northwest Booster Pump Station and transmission main is a critical water infrastructure project that will improve water delivery and pressure in the northwest region ensuring water quality standards are met. This project will also provide a direct connection between the two elevated storage tanks (Riney Road and Northwest) which will help reduce the time required to fill the tanks as well as reduce the age (the time it takes for water to travel from the treatment facility to the tap) of water in the northwest pressure plane. The original design contract with Kimley-Horn for $1,398,600 was approved by City Council on January 14, 2020, subsequently amended for the first time on January 12, 2021, to include additional services that were not included in the original contract. As part of the project, additional waterline segments were added which required additional design services, permitting services, and construction administration services. Kimley-Horn and Associates Inc. started working on the design of the northwest booster pump station and the transmission line in early 2020 and since then the underlying future land use assumptions that were used for developing the design have changed. The change in land use assumptions and considerable interest from private developers for large commercial/industrial development along the I-35 corridor north of US-380 has increased the overall demand on the water system resulting in a need for additional capacity. Given that this project is currently in the design phase, staff recommends updating/revising the design to include the additional capacity to accommodate future water demand in the northwest region of the City. As such, the existing scope for Kimley-Horn has to be amended to include additional hydraulic analysis and design effort to ensure the water lines and their appurtenances are upgraded to meet future demands. This will include additional design effort for the upsizing of the planned water line and upsizing of the pumps and motors. City Hall 215 E. It should be noted that the total change orders requested for this project are roughly 2% of the overall cost of the project. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On January 14, 2020, City Council approved a contract with Kimley-Horn and Associates, Inc., in the not- to-exceed amount of $1,398,600 (Ordinance 19-2973). On January 12, 2021, City Council approved Amendment 1 with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $126,300 (Ordinance 21-018). On November 8, 2021, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award Amendment No. 2 with Kimley-Horn and Associates, Inc., for additional design engineer services, and hydraulic analysis in support of the Northwest Booster Pump Station and Water Transmission Main project, in a not-to-exceed amount of $248,500, for a total amended contract amount of $1,773,400.
