Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement & Compliance ACM: David Gaines DATE: December 14, 2021 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a Professional Services Agreement with Kimley-Horn and Associates, Inc., to provide project management, data collection, contract reviews, contract matrix development, and post-analysis services support for the Water Resource Management Analysis Project for the Water Utilities Division; providing for the expenditure of funds therefor; and providing an effective date (RFQ 7574-007 – Professional Services Agreement for analysis services awarded to Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $95,000.00). INFORMATION/BACKGROUND The City of Denton Water Utilities Division is requesting assistance with the analysis and planning associated with the City’s water resource obligations. Currently, there are several expired contracts with the City of Dallas and the Upper Trinity Water District that need to be renewed and or re-negotiated. These contracts directly impact the City’s water portfolio with regards to the purchase and sale of raw water. In addition, they outline the operating agreements for both Lake Lewisville and Lake Ray Roberts. This analysis will include the collection of all current contracts, review of contracts and associated documents, development of a contract summary matrix, and Kimley-Horn and Associates will provide recommendations for steps forward. The Engineer will review the Average Day and/or Peak Day commitments including the level of service provided by the City of Denton with other entities. The Engineer will also develop a comprehensive contract matrix including all water and wastewater contract terms and provisions as well as a quick reference guide for future use. This analysis will assist with the future development of the Water and Wastewater Master Plans, distinguishing future infrastructure improvements throughout the City of Denton. Based on the qualifications, knowledge, and experience in designing projects of similar type and magnitude, staff selected Kimley-Horn and Associates, Inc. from a list of qualified consultants to perform this work. Request for Qualifications for professional engineering services for Water and Wastewater was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 23, 201 (Ordinance 21-546). City Hall 215 E. McKinney Street Denton, Texas www.cityofdenton.com PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 23, 2021, Council approved RFQ 7574 for a prequalified list of professional engineering firms for Water and Wastewater (Ordinance 21-546). On December 13, 2021, this item will be presented to the Public Utilities Board (PUB) for consideration. RECOMMENDATION Award a contract with Kimley-Horn and Associates, Inc., to provide project management, data collection, contract reviews, contract matrix development, and post-analysis services support for the Water Resource Management Analysis Project for the Water Utilities Division, in a not-to-exceed amount of $95,000. PRINCIPAL PLACE OF BUSINESS Kimley-Horn and Associates, Inc. Fort Worth, TX ESTIMATED SCHEDULE OF PROJECT This project will be started upon approval with a completion date of May 2022.
