SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with Archer Western Construction, LLC, for the Effluent
Filter, Aeration Diffuser, and Digester Improvements for the Pecan Creek Water Reclamation Plant for the
Water Reclamation Department; providing for the expenditure of funds therefor; and providing an effective
date (CSP 7855 – awarded to Archer Western Construction, LLC, in the not-to-exceed amount of
$13,509,221.00). The Public Utilities Board recommends approval (4 - 0).
INFORMATION/BACKGROUND
The proposed contract is for the first phase of construction for the Pecan Creek Water Reclamation Plant
(PCWRP) which serves as the City’s primary wastewater treatment facility. PCWRP is currently permitted
for an annual average capacity of 21 million gallons per day (MGD) and 46 MGD Peak 2-hour flow (P2HF).
Currently, the facility treats 14-15 million gallons per day of wastewater, which is currently 71% of the
permitted limit. The Texas Commission on Environmental Quality (TCEQ) regulations state that a utility
must begin design for capacity expansion when flows reach 75% of permit limits and must begin
construction of improvements when flows reach 90% of permit limits.
In March of 2021, the City proactively entered a design contract with Hazen and Sawyer, P.C. to design
and prepare construction documents, along with providing bid assistance and construction administration
support for the necessary capacity expansion improvements to meet future growth and TCEQ requirements.
The improvements are anticipated to be completed through three (3) phases.

The first phase includes replacement of Effluent Sand Filters with higher capacity Aqua Diamond Cloth
Filters, replacement of existing ceramic diffusers in the aeration system with new membrane diffusers which
will increase air transfer efficiency, cleaning the existing two (2) anaerobic digesters, and replacing the lid
of the primary digester with a gas holding lid so that Methane gas can be properly collected.

Upon completion of the design of phases two (1B) and three (1C), construction proposals will be
individually solicited and brought forward for Council approval.
In addition, the City has engaged Hazen and Sawyer, P.C. to assist through the TCEQ permitting process
which will run concurrently with the construction phases.
The Effluent Filter, Aeration Diffuser, and Digester Improvements for the Pecan Creek Water Reclamation
Plant have a total estimated cost of $13,509,221. This estimate includes a $12,281,110 total base bid amount
and a contingency of $1,228,111. A contingency allowance, if any, is for the sole use of the City and will
be subject to written authorization by the City’s Project Manager and Program Manager.
Competitive Sealed Proposals were sent to 11 prospective suppliers. In addition, specifications were placed
on the Procurement and Compliance website for prospective suppliers to download and advertised in the
local newspaper. Notifications were sent to three (3) planning rooms, Construction Journal, Construct
Connect, and Blue Book, for vendors to view. Two (2) proposals were received, references were checked,
and proposals were evaluated based upon published criteria including key personnel, quality, schedule,
safety, and price. Best and Final Offers (BAFO) were requested from the top firm. Based upon this
evaluation, Archer Western Construction, LLC was ranked the highest and determined to be the best value
for the City.

On March 14, 2022, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award a contract with Archer Western Construction, LLC, for the Effluent Filter, Aeration Diffuser, and
Digester Improvements for the Pecan Creek Water Reclamation Plant for the Water Reclamation
Department, in the not-to-exceed amount of $13,509,221.
