AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION, AUTHORIZING THE APPROVAL OF A THIRD AMENDMENT TO ACONTRACT BETWEEN THE CITY OF DENTON AND LABOR FIRST, LLC DBA RETIREE
FIRST, LLC, AMENDING THE CONTRACT APPROVED BY CITY COUNCIL ON OCTOBER16, 2018, IN THE NOT-TO-EXCEED AMOUNT OF $2,440,000.00; AMENDED BY
AMENDMENTS 1 AND 2 APPROVED BY PURCHASING; SAID THIRD AMENDMENT TOCONTINUE TO PROVIDE THE MEDICARE SUPPLEMENT COVERAGE, INCLUDING
MEDICAL SERVICES AND PRESCRIPTION SERVICES FOR THE CITY’S POST-65RETIREES; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND
PROVIDING AN EFFECTIVE DATE (RFP 6807 –PROVEDING FOR AN ADDITIONAL THIRDAMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $610,000.00, WITH THE
TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $3,050,000.00).
WHEREAS, on October 16, 2018, City Council awarded a contract to Labor First, LLC dba
Retiree First, LLC, in the amount of $2,440,000.00, for the administration of post-65 retiree
Medicare Supplement; and
WHEREAS, on November 20, 2018, Purchasing awarded a First Amendment to Labor First,
LLC dba Retiree First, LLC, to clarify the Contractor’s Proposal; and
WHEREAS, on October 6, 2020, Purchasing awarded a Second Amendment to Labor First,
LLC dba Retiree First, LLC, for an extension of the contract; and
WHEREAS, the additional fees under the proposed Third Amendment are fair and
reasonable and are consistent with, and not higher than, the recommended practices and fees
applicable to the Provider’s profession, and such fees do not exceed the maximum provided by law;NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Third Amendment, increasing the amount of the contract between the City
and Labor First, LLC dba Retiree First, LLC, which is on file in the office of the Purchasing Agent,
in the amount of Six Hundred Ten Thousand and 0/100 ($610,000.00) Dollars, is hereby approved,
and the expenditure of funds therefor is hereby authorized in accordance with said amendment
which shall be effective upon the execution of the amendment attached hereto. The total contract
amount increases to $3,050,000.00.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval.
