SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a contract with Mario Sinacola & Sons Excavating, Inc., for the
construction of the Hickory Creek Road Phase 3 Project consisting of the realignment and bridge installation
of Hickory Creek Road between FM 1830 to Riverpass; providing for the expenditure of funds therefor; and
providing an effective date (CSP 7909 – awarded to Mario Sinacola & Sons Excavating, Inc., in the not-to-
exceed amount of $52,022,433.88).
INFORMATION/BACKGROUND
The Hickory Creek Road Phase 3 Project requires a four-lane extension and realignment of Hickory Creek
Road from Riverpass Drive to FM-1830. The project will include the construction of a bridge that will span
over Hickory Creek and remove the safety concern of the 90-degree curve from the current Hickory Creek
Road alignment.
In February of 2019, City Council approved Ordinance No. 19-351 that awarded a contract to HDR
Engineering, Inc. to provide for the design and right-of-way acquisition for the Hickory Creek Road Phase
3 Project. The Capital Projects Department committed to advertising the project in December 2021and to
be in construction by Q2 2022. With the approval of this contract, commitments will be met.
The Hickory Creek Road Phase 3 Project has a total estimated cost of $52,022,433.88. This estimate
includes a $49,545,175.12 total base proposal amount and a contingency of $2,477,258.76. A five (5)
percent contingency allowance, if any, is for the sole use of the City and will be subject to written
authorization by the City’s Project Manager and Program Manager.

The contractor, Mario Sinacola & Sons Excavating, Inc., was selected during the Competitive Sealed
Proposal process based on the company’s key personnel, reputation & ability to complete similar projects,
detailed schedule, safety record, and proposal cost. The selected contractor rated in the range of above-
average to superior in all categories. The detailed schedule and written plan were presented thoroughly with
a focus on critical path scheduling and action plans. References that were contacted gave the contractor
excellent reviews for the quality of work and reputation. Key personnel requirements submitted were in-
depth on the company’s level of experience. The evaluation team combined category scoring and proposal
price of all three offerors to make the selection Mario Sinacola & Sons Excavating Inc. The selected
contractor ranked the highest in all categories except proposal price, in which Mario Sinacola & Sons
Excavating, Inc. was ranked second.
Competitive Sealed Proposals were sent to 518 prospective suppliers, including 38 Denton firms, of this
item. In addition, specifications were placed on the Procurement website for prospective suppliers to
download and advertised in the local newspaper. Three (3) proposals were received, references were
checked, and proposals were evaluated based upon published criteria including key personnel, quality,
reputation, ability to complete projects on schedule and within budget, detailed schedule and written plan,
safety record, and price. Best and Final Offers (BAFO) were requested from the top firm. Based upon this
evaluation, Mario Sinacola & Sons Excavating, Inc., was ranked the highest and determined to be the best
value for the City.

RECOMMENDATION

This project will be started upon approval of a notice to proceed with a substantial completion date within

FISCAL INFORMATION
Due to the projected spend schedule, the 2019 Bond Program Commercial Paper Program will be used to
provide contract appropriation authority. This project will be funded incrementally through the course of
the construction with RTR funds, 2019 Bond Program funds, and Street/Traffic funds. The accounts
numbers are as follows: 250081473.1360.40100, 250081467.1360.40100, and 250081402.1360.40100.
