SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a Professional Services Agreement with Kimley-Horn and
Associates, Inc., for professional engineering services related to the Union Pacific Railroad (UPRR)
Downtown Quiet Zone design for the City of Denton as set forth in the contract; providing for the
expenditure of funds therefor; and providing an effective date (RFQ 7292-006 – Professional Services
Agreement for engineering services awarded to Kimley-Horn and Associates, Inc., in the not-to-exceed
amount of $312,000.00).
INFORMATION/BACKGROUND
Implementation of Quite Zones (QZ) along the Union Pacific Railroad (UPRR) was funded through the
2014 Bond Election in downtown Denton at the following grade crossings Prairie, Sycamore, Hickory, and
McKinney.
In 2018, in-house design efforts began along with the required coordination with UPRR. All locations but
Hickory will be accomplished using raised medians to separate the vehicular traffic and prohibit drivers
from navigating around the existing crossing arms. At Hickory, a quad-gate installation will be employed
and will require the reconstruction of the existing crossing warning system.
On September 20, 2020, a Public Highway At-Grade Crossing agreement was entered into by the City and
UPRR (Ordinance Number 20-1699).
In April 2021, a professional services agreement was executed with Kimley Horn & Associates, Inc. for
Downtown Quiet Zones Program Management Services, providing oversight and feedback on the in-house
design efforts and providing coordination with UPRR.
In late 2021, after further project review by our Capital Projects team, it was determined pedestrian
improvements should be made simultaneously with the quiet zone roadway improvements providing
sidewalk connectivity through the RR crossings including any UPRR safety enhancements such as gates.
Request for Qualifications for professional transportation engineering services was solicited using the
City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March
23, 2021 (Ordinance 21-554).

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 23, 2021, Council approved RFQ 7292 for a prequalified list of professional transportation
engineering firms (Ordinance 21-554).
RECOMMENDATION
Award a contract with Kimley-Horn and Associates, Inc., for professional engineering services related to
the Union Pacific Railroad (UPRR) Downtown Quiet Zone design for the City of Denton, in a not-to-exceed
amount of $312,000.

FISCAL INFORMATION
These services will be funded from Rail Quiet Zone McKinney/Streets-Traffic GO account 310001402 and
BE14 Rail Quiet Zone McKinney/Streets Traffic GO account 31001467. Requisition #155445 has been
entered into the Purchasing software system in the amount of $312,000. The budgeted amount for this item
is $312,000.
