Description of work
1) Cost of Additional Railroad Coordination with UPRR. Original cost was based on design plans to tunnel approx. 400‐foot of which 150‐foot
was under the UPRR Right‐of‐Way and 250‐foot was under US 377/TxDOT ROW. There were two bore pits (one on each end of the tunnel).
The Railroad Coordination costs were estimated based on the 150‐foot section of tunnel under the UPRR ROW (not the entire 400‐feet). Once
tunneling started on the downstream end (eastern TxDOT ROW), UPRR/Railpros began inspecting immediately stating the UPRR tunnel actually
started at the beginning of the 400‐foot tunnel at the eastern TxDOT ROW line not at the eastern UPRR ROW line. This added 250‐feet of
additional Railpros inspection. As risk managment, an option was considered that would create an intermediate bore pit in TxDOT ROW along
the UPRR eastern ROW line (effectively breaking the single 400‐foot tunnel into two sections). An intermediate bore pit was not considered
necessary during design for a tunnel length of 400‐ft. The contractor and design engineer evaluated the option to add a "intermediate" bore pit
for the purpose to define a 150‐foot tunnel under UPRR. The grades, access, and weather conditions were too difficult to expedite a bore pit
design and construction and would still require additional coordination and permitting with TxDOT to approve a bore pit in TxDOT ROW. To
maintain schedule, the contractor proceeded with the original plan for a single 400‐foot long tunnel, two bore pits, and they expedited
construction as much as possible by working overtime and weekends.
2) Extend pipe and provide connection between Glenwood Meadows development and HCI 1&2. Development was not required to extend a
pipe for tie to HCI 1&2. In order to abandon the existing interceptor, the extension and connection were required. Denton
Utilities/Wastewater provided the 8" pipe for the extension.
3) Overrun of estimated quantity for Bore Length Item 7 (Estimated length = 399 feet, actual length = 415 feet)

From time to time, City of Denton (we, us or Company) may be required by law to provide to
you certain written notices or disclosures. Described below are the terms and conditions for
providing to you such notices and disclosures electronically through your DocuSign, Inc.
(DocuSign) Express user account. Please read the information below carefully and thoroughly,
and if you can access this information electronically to your satisfaction and agree to these terms

Getting paper copies
At any time, you may request from us a paper copy of any record provided or made available
electronically to you by us. For such copies, as long as you are an authorized user of the
DocuSign system you will have the ability to download and print any documents we send to you

documents are first sent to you. After such time, if you wish for us to send you paper copies of

If you decide to receive notices and disclosures from us electronically, you may at any time

Consequences of changing your mind

DocuSign account. This will indicate to us that you have withdrawn your consent to receive
required notices and disclosures electronically from us and you will no longer be able to use your
DocuSign Express user account to receive required notices and consents electronically from us
or to sign electronically documents from us.

Unless you tell us otherwise in accordance with the procedures described herein, we will provide
electronically to you through your DocuSign user account all required notices, disclosures,
authorizations, acknowledgements, and other documents that are required to be provided or
made available to you during the course of our relationship with you. To reduce the chance of
you inadvertently not receiving any notice or disclosure, we prefer to provide all of the required
notices and disclosures to you by the same method and to the same address that you have given
us. Thus, you can receive all the disclosures and notices electronically or in paper format through
the paper mail delivery system. If you do not agree with this process, please let us know as
