(“Engineer”); to that certain contract executed on December 14, 2021, in the original not- to-exceed amount of $726,610 (the “Agreement”); for services related to Neighborhood 7A Improvement Design. WHEREAS, the City deems it necessary to further expand the services provided by Consultant to the City pursuant to the terms of the Agreement, and to provide an additional not-to-exceed amount $28,008 with this Amendment for an aggregate not-to-exceed amount of $754,618; and FURTHERMORE, the City deems it necessary to further expand the goods/services provided by Engineer to the City; NOW THEREFORE, the City and Engineer (hereafter collectively referred to as the “Parties”), in consideration of their mutual promises and covenants, as well as for other good and valuable considerations, do hereby AGREE to the following Amendment, which amends the following terms and conditions of the said Agreement, to wit: 1. The additional services described in Exhibit “A” of this Amendment, attached hereto and incorporated herein for all purposes, for professional services related to the design of Neighborhood 7A Improvements Project, are hereby authorized to be performed by Engineer. For and in consideration of the additional services to be performed by Engineer, the City agrees to pay, based on the cost estimate detail attached as Exhibit “A”, a total fee, including reimbursement for non-labor expenses an amount not to exceed $28,008. 2. This Amendment modifies the Agreement amount to provide an additional $28,008 for the additional services with a revised aggregate not to exceed total of $754,618. The Parties hereto agree, that except as specifically provided for by this Amendment, that all of the terms, covenants, conditions, agreements, rights, responsibilities, and obligations of the Parties, set forth in the Agreement remain in full force and effect. Specifically, these additional services include: Additional Topographic Survey: CONSULTANT shall provide all office and field work necessary to perform an additional Topographic Design Survey along the alley between Jasmine Street and Camellia Street from Laurel Street to Parvin Street. The limits of the additional survey will extend to each side of the approximate alley right of way. All survey information provided by the CONSULTANT will be referenced to Grid North of the Texas Coordinate System of 1983 {North Central Zone No. 4202; NAD83(2011) Epoch 2010} as derived locally from Allterra Central’s continuously operating reference stations via real time kinematic survey methods. Elevations will be referenced to NAVD88 datum as derived from RTK observations. Orthometric heights will be calculated by applying the Geoid 12B model to ellipsoid heights. CONSULTANT shall perform all surveying services in accordance with the General Rules and Procedures of Practice, and the Professional and Technical Standards established by the Texas Board of Professional Engineers and Land Surveyors. Easement Documents: CONSULTANT shall provide all office and field work necessary to prepare up to two (2) Sidewalk Easement Documents, one along a called 1.095-acre tract of land currently owned by George M. Jenson and wife Pat Ann Jenson, aka 2000 Bernard Street and the other at the corner of Bernard and Parvin Streets. Sufficient property corners will be located and reviewed by a Registered Professional Land Surveyor to determine property lines and rights-of-way as necessary to develop the limits of the easement parcel. Additional Subsurface Utility Engineering: CONSULTANT shall provide all office and field work necessary to perform additional Level B Subsurface Utility Engineering along the alley between Jasmine Street and Camellia. This work will follow the requirements and scope in the original contract documents for Quality Level B designation and will be subject to the terms and conditions of that contract. Additional Paving Design: The CONSULTANT will design and prepare plans for the alley between Jasmine Street and Camellia Street according to the contract scope and design direction provided by the City to date on this project. The CONSULTANT will walk the project with City staff to identify site specific paving requirements and will hold regular progress meetings with the City staff on to allow input on the design while maintaining the project schedule. Deliverables: Additional Topographic Survey: topographic base file prepared in AutoCAD Civil 3D format for in- house design purposes only will be provided. Additional Subsurface Utility Engineering: Drawings based on ASCE Standard 38-02, will be signed and sealed by a Professional Engineer registered in the State of Texas, and will consist of an AutoCAD DWG 2d (DGN) file depicting all Sub-surface Utilities Designated, with a PDF of the same signed and sealed by a Professional Engineer registered in the State of Texas and ACSII Point List. Schedule: Additional Topographic Survey: Field work for additional topographic survey will commence upon receipt of authorization to proceed from the City and all topographic survey will be completed within 4 weeks of authorization to proceed. Easement Documents: Field work for the proposed easement will commence upon receipt of authorization to proceed from the City and will be completed within 4 weeks of authorization to proceed. Additional Subsurface Utility Engineering: Field work for subsurface utility engineering will commence within 2 weeks of authorization to proceed from the City and will be completed within 5 weeks of authorization to proceed. Additional Paving Design: The design of the additional paving plans for the alley will commence upon completion of the topographic survey and progress concurrently with other tasks included in this amendment. The CONSULTANT will hold regular progress meeting with City staff in order to allow for City input with a compressed schedule. Final plans will be completed within 4 weeks of delivery of the Subsurface Utility Engineering data.
