Exhibit 1 - Agenda Information Sheet Amend 4City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement DCM: David Gaines DATE: June 28, 2022 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a fourth amendment to a Professional Services Agreement between the City of Denton and Halff Associates, Inc., amending the contract approved by City Council on November 6, 2018, in the not-to-exceed amount of $837,900.00, amended by Amendments 1-3 approved by Procurement and City Council, said fourth amendment to provide a Drainage Study on Oakland Street for the Capital Improvement Projects Department; providing for the expenditure of funds therefor; and providing an effective date (File 6590-041 – providing for an additional fourth amendment expenditure amount not-to- exceed $84,000.00, with the total contract amount not-to-exceed $1,140,040.00). The Public Utilities Board recommends approval (5 – 0). INFORMATION/BACKGROUND In November 2018, City Council approved a contract with Halff Associates, Inc. for the design of the Elm and Locust Phase 2 Project. Halff Associates was also contracted to perform the Watershed Study along the Pecan Creek Tributary in October 2017. The staff has reevaluated the project scope of Elm and Locust Phase 2 while scoping the neighborhood rehabilitation program associated with the 2019 Street Reconstruction Bond. Staff found the two (2) areas had several street segments that overlapped and identified the need for a larger drainage system incorporating the Oakland Street area along North Pecan Creek. With the approval of this amendment, Halff Associates will model the existing conditions and simulate the 10, 25, 50, and 100-year flows. Based on the model results, level of service summary, and inundation mapping, Halff Associates will provide a report presenting the data including an opinion of probable construction costs for the final selected alternative. Staff will utilize this information for budget planning within the coming years' Capital Improvement Projects budget. PRIOR ACTION/REVIEW (Council, Boards, Commissions) On November 6, 2018, City Council approved a contract with Halff Associates, Inc., in the not-to-exceed amount of $837,900 (Ordinance 18-1662). On June 19, 2019, Procurement approved the first amendment with Halff Associates, Inc., in the not-to- exceed amount of $40,300. On May 13, 2020, Procurement approved a second amendment with Halff Associates, Inc., for a 5% billing reduction due to Covid-19 from April 2020 until June 30, 2020. City Hall 215 E. On June 13, 2022, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award Amendment No. 4 with Halff Associates, Inc., for a Drainage Study on Oakland Street for the Capital Improvement Projects Department, in a not-to-exceed amount of $84,000, for a total amended contract amount of $1,140,040. PRINCIPAL PLACE OF BUSINESS Halff Associates, Inc. Fort Worth, TX ESTIMATED SCHEDULE OF PROJECT This project will be started upon approval with a completion date by September 30, 2022. FISCAL INFORMATION These services will be funded from Drainage Channel Rehab account 650039561.1360.20100. Purchase Order #187638 will be revised to include the fourth amendment amount of $84,000. The total amount of this contract is $1,140,040.
