SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a Professional Services Agreement between the City of
Denton and Parkhill, Smith & Cooper, Inc., amending the contract approved by Purchasing on October 23,
2020, in the not-to-exceed amount of $43,490.00, said first amendment to provide Moseley Road Erosion
Maintenance for the Solid Waste Department; providing for the expenditure of funds therefor; and
providing an effective date (RFQ 7109-013 – providing for an additional first amendment expenditure
amount not-to-exceed $130,900.00, for a total contract amount not-to-exceed $174,390.00). The Public
Utilities Board recommends approval (6 - 0).
INFORMATION/BACKGROUND
On October 23, 2020, the City entered into a Contract with Parkhill, Smith & Cooper, Inc. for the Moseley
Road Erosion Maintenance. Since that time, the 60% design deliverable was submitted to the City on
February 5, 2021, and subsequently, the project was put on hold for approximately 12 months, leading to
labor cost increases, and costs associated with restarting the project, not anticipated in the original proposal.
The final plan set was submitted to the City on April 28, 2022. Parkhill, Smith & Cooper, Inc. has been
asked to provide additional engineering services for the construction phase, which are required by the Texas
Commission on Environmental Quality rules for landfill cover construction.
The purpose of this contract amendment is to provide additional engineering services for the construction
phase.

On July 25, 2022, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Award Amendment No. 1 with Parkhill, Smith & Cooper, Inc., for Moseley Road Erosion Maintenance for
the Solid Waste Department, in a not-to-exceed amount of $130,900, for a total amended contract amount
of $174,390.

Order #194780 will be revised to include the first amendment amount of $130,900. The total amount of this
contract is $174,390.
