SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a Professional Services Agreement between the City of
Denton and Freese and Nichols, Inc., amending the contract approved by City Council on September 22,
2020, in the not-to-exceed amount of $1,472,700.00; amended by Amendment 1 approved by City Council;
said second amendment to provide additional professional, construction, and bid phase services for the Lake
Ray Roberts Regulatory and Performance Upgrade Project; providing for the expenditure of funds therefor;
and providing an effective date (File 6590-093 – providing for an additional second amendment expenditure
amount not-to-exceed $1,470,477.00, with the total contract amount not-to-exceed $3,606,487.00).
INFORMATION/BACKGROUND
The Ray Roberts Water Treatment Plant (RRWTP) was constructed and placed into service in 2002, with
a capacity of 20 million gallons per day (MGD). Since the in-service date, the facility has received no major
maintenance or upgrades and numerous components are reaching their design life and need replacement or
repair.
Water Utilities staff engaged Freese and Nichols in 2019 to prepare a Preliminary Design Report to evaluate
the condition of equipment, structures, and processes at the RRWTP and make recommendations for work
to be included in a Regulatory and Performance Upgrade project. The report was completed in August 2019,
at which time staff began forming a scope of work and negotiating a professional services fee. In the
winter/spring of 2020 staff developed a plan to defer the major capacity expansion at RRWTP by
completing a treatment capacity uprate study and permitting through the Texas Commission on
Environmental Quality (TCEQ).
As a result of the findings in the Preliminary Design Report, and to better meet regulatory and performance
needs, a construction-ready design has been completed by Freese and Nichols Inc.
Components of the plant included in this project:
• Filter and backwash water supply upgrade
• Flocculation basin rehabilitation
• Valve actuator replacements
• Chemical containment basin construction
• High-service pump control building

Staff expects the plant capacity to be uprated from 20 mgd to 25-30 mgd using existing process systems.
This amendment provides general project management, construction, and bid phase services that are needed
to help facilitate the construction portion of this project. The Lake Ray Roberts Regulatory and Performance
Upgrade Project is tentatively scheduled to be ready for bid in the 1st quarter of 2023. Denton Water Utilities
will then bring the construction contract for approval by Council at that time.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On September 22, 2020, City Council approved a contract with Freese and Nichols, Inc., in the not-to-exceed
amount of $1,472,700 (Ordinance 20-1828).
On December 14, 2021, City Council approved Amendment No. 1, with Freese and Nichols, Inc., in the amount
of $663,310, with a total not-to-exceed amount of $2,136,010 (Ordinance 21-2680).
On November 14, 2022, this item will be presented to the Public Utilities Board (PUB) for consideration.
RECOMMENDATION
Award amendment No. 2 to the contract with Freese & Nichols, Inc., to provide additional professional,
construction, and bid phase services for the Lake Ray Roberts Regulatory and Performance Upgrade
Project, in the not-to-exceed amount of $1,470,477.

FISCAL INFORMATION
These services will be funded from Water Department account 630409517. Purchase Order #195063 will
be revised to include the second amendment amount of $1,470,477. The total amount of this contract is
$3,606,487.
