SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of Change Order No. 2 to the contract between the City of Denton and Mountain
Cascade of Texas, LLC, for the construction of the North South Phase III 42-inch Water Transmission Line
Project for the City of Denton; providing for the expenditure of funds therefor; and providing an effective
date (IFB 7200-1– Change Order No. 2 in the not-to-exceed amount of $220,574.60, for a total contract
award aggregated to $4,439,953.34).
INFORMATION/BACKGROUND
The North South Water Main Phase III Project completes the final phase of the three-phase project by
providing 4,300 linear feet of 42-inch, 16-inch, and 12-inch water lines along Bonnie Brae Street from I-
35E Service Road to Panhandle Street. This project is on the City’s water masterplan and provides more
adequate and reliable water service to customers. The City entered into a contract with Mountain Cascade
of Texas, LLC on June 22, 2021, to complete the North South Phase III Project.
Change Order No. 1 in the amount of $255,476.70 was approved by City Council on April 5, 2022, and
consisted of added Industrial Hygienist services required for excavation near the gas station. Also,
increasing paving from two (2) to all four (4) lanes of Bonnie Brae due to extensive deterioration of
southbound traffic lanes while the project has been under construction.
Change Order No. 2 in the amount of $220,574.60 is the final prove-out change order for the project
consisting of over and under runs of the following items:
▪ Reconnect Water Meter Long (4 additional meters not reflected in plans)
▪ Reconnect Water Meter Short (3 additional meters not reflected in plans)
▪ Manway Vault (1 additional vault than shown in the plan)
▪ 16" DIP Special Class 52 (additional 16’ plus bend required to avoid DME Dist. Line
▪ Quantity overruns for Curb & Gutter, Sidewalk, and Drive Approaches
▪ Asphalt Pavement Repair deduct for areas not requiring full-depth mill & asphalt
▪ Addition of 120 days due to material availability including concrete and paving delays
PRIOR ACTION/VIEW (COUNCIL, BOARDS, COMMISSIONS)
On June 22, 2021, City Council approved a contract with Mountain Cascade of Texas, LLC, in the not-to-
exceed amount of $3,963,902.04 (Ordinance 21-1265).

On April 5, 2022, City Council approved Change Order No. 1 with Mountain Cascade of Texas, LLC, in
the amount of $255,476.70, for a total not-to-exceed amount of $4,219,378.74 (Ordinance 22-631).
On November 14, 2022, this item will be presented to the Public Utilities Board (PUB) for consideration.
RECOMMENDATION
Award Change Order No. 2 with Mountain Cascade of Texas, LLC., for the construction of the North South
Phase III 42-inch Water Transmission Line Project for the City of Denton, in a not-to-exceed amount of
$220,574.60, for a total amended contract amount of $4,439,953.34.

FISCAL INFORMATION
These items will be funded from Water Impact Fees account 630282525.1360.40100. Purchase Order
#197078 will be revised to include the Change Order 2 amount of $220,574.60. The total amount of this
contract is $4,439,953.34.
