Exhibit 1 - Agenda Information Sheet Amendment 4City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement CFO: Cassey Ogden DATE: December 13, 2022 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a fourth amendment to a Professional Services Agreement between the City of Denton and Kimley-Horn and Associates, Inc., amending the contract approved by the City Council on January 14, 2020, in the not-to-exceed amount of $1,398,600.00; amended by Amendments 1 - 3 approved by Purchasing and City Council; said fourth amendment to provide additional design engineer services and construction administration services in support of the Northwest Booster Pump Station and Water Transmission Main project; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6590-081 – providing for an additional fourth amendment expenditure amount not-to-exceed $100,000.00, with the total contract amount not-to-exceed $1,905,900.00). INFORMATION/BACKGROUND The Northwest Booster Pump Station and Water Transmission Main are identified in the Water Distribution Master Plan. This pump station and transmission main will ensure water quality standards are met and improve service to the community. The first amendment to the Professional Services Agreement with Kimley-Horn and Associates, Inc. (6590- 081) provided additional design engineer services, permitting services, and construction administration services for 600 ft of fiber communication, 2,600 ft of 12-inch water distribution main and 700 ft of 8-inch wastewater force main. As a result of changes in land use along the I-35 corridor north of US 380, the second amendment provided additional design engineer services and hydraulic analysis resulting in an updated/revised design to accommodate the future water demands. The third amendment provided the design of a 16-inch distribution main included in the Water Master Plan and will provide redundant water supply to the community along Bonnie Brae, including the new Denton High School. The proposed fourth amendment is requested for additional design services related to the electric meter, utility disconnect, and primary conductor revisions at the booster pump station. Included are modifications to the network switch cabinet, conduit, variable frequency drive panel, and HOA (hand, off, auto) switches. The amendment also covers needed coordination items with stakeholders along the proposed Northwest Water Transmission Main alignment, which were not originally anticipated within the original scope of services. In addition, it will provide services in accordance with the original contract on an as-needed basis only. Supplementary work will not be approved without written authorization from the Water Utilities Department. It is anticipated that this will be the last amendment to the contract. City Hall 215 E. The Northwest Water Transmission Main is anticipated to begin construction in the second quarter of 2023. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On January 14, 2020, City Council approved a Professional Services Agreement with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $1,398,600. On January 12, 2021, City Council approved Amendment 1 with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $126,300, for a total not-to-exceed amount of $1,524,900. On November 16, 2021, City Council approved Amendment 2 with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $248,500, for a total not-to-exceed amount of $1,773,400. On April 14, 2022, Purchasing approved Amendment 3 with Kimley-Horn and Associates, Inc., in the not- to-exceed amount of $32,500, for a total not-to-exceed amount of $1,805,900. On December 12, 2022, this item will be presented to the Public Utilities Board (PUB) for consideration. RECOMMENDATION Award Amendment No. 4 with Kimley-Horn and Associates, Inc., to provide additional design engineer services and construction administration services in support of the Northwest Booster Pump Station and Water Transmission Main project, in a not-to-exceed amount of $100,000, for a total amended contract amount of $1,905,900. Purchase Order # 192247 will be revised to include the fourth amendment amount of $100,000. The total amount of this contract is $$1,905,900.
