SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a Professional Services Agreement between the City of
Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on March
16, 2021, in the not-to-exceed amount of $215,000.00; said first amendment for professional engineering
services related to Ginnings Elementary School and Alexander Elementary School Safe Routes to School
Sidewalk Improvements; providing for the expenditure of funds therefor; and providing an effective date
(RFQ 6590-102 – providing for an additional first amendment expenditure amount not-to-exceed
$216,000.00, with the total contract amount not-to-exceed $431,000.00).
INFORMATION/BACKGROUND
On March 8, 2019, an Advanced Funding Agreement (AFA) CSJ#0918-46-305 was authorized by the Texas
Department of Transportation (TxDOT) and the City of Denton to provide funding reimbursement in the
not-to-exceed amount of $762,311.00, for project design, right-of-way acquisition, utility relocations, and
construction activities. The Safe Routes to School (SRTS) projects include pedestrian and bicycle
infrastructure that will substantially improve safety and the ability for students to walk and bike to schools.
The City of Denton selected projects in coordination with the Denton Independent School District which
has identified the Ginnings and Alexander (formerly named Lee) Elementary Schools as candidates in need
of sidewalk connectivity. The current estimated cost including design, right-of-way acquisition, utility
relocation, city staff time, and construction of these sidewalks is $1,706,000.00.
This project has also been approved for the Denton County Transportation Authority’s (DCTA) fiscal year
2021, Transportation Reinvestment Program (TRiP) funding in the not-to-exceed amount of $505,861.00.
Amendment No. 1 adds turnkey Right of Way Acquisition Services for 18 parcels. These acquisitions are
needed prior to our August 2023 TxDOT set-letting schedule. These services will be performed under the
guidance of our Real Estate Department.
Request for Qualifications for professional engineering services was solicited using the City’s formal
solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018, and
June 5, 2018 (Ordinance 2018-331).

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional
engineering firms (Ordinance 2018-331).
On March 16, 2021, City Council approved the Professional Service Agreement with Kimley-Horn and
Associates, Inc., in the not-to-exceed amount of $215,000 (Ordinance 2021-417)
RECOMMENDATION
Award Amendment No. 1 with Kimley-Horn and Associates, Inc., for additional professional engineering
services related to Ginnings Elementary School and Alexander Elementary School Safe Routes to School
Sidewalk Improvements, in a not-to-exceed amount of $216,000, for a total amended contract amount of
$431,000.

amount of this contract is $431,000.
