Exhibit 1 - Agenda Information Sheet Amendment 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement INTERIM ACM: Cassey Ogden DATE: February 7, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a Professional Services Agreement between the City of Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on March 16, 2021, in the not-to-exceed amount of $150,000.00; amended by Amendment 1 approved by Purchasing; said second amendment for additional professional engineering services in support of the Nette Shultz (formerly Wilson) Elementary School and Pecan Creek Elementary School Safe Routes to Schools Sidewalk Improvements project, as set forth in the amendment; providing for the expenditure of funds therefor; and providing an effective date (RFQ 6590-105 – providing for an additional second amendment expenditure amount not-to-exceed $120,000.00, with the total contract amount not-to-exceed $306,500.00). INFORMATION/BACKGROUND On November 28, 2018, an Advanced Funding Agreement (AFA) CSJ#0918-46-267 was authorized by the Texas Department of Transportation (TxDOT) and the City of Denton to provide funding reimbursement in the not-to-exceed amount of $438,820, for project design, right-of-way acquisition, and construction activities. This project is in support of the Safe Routes to School Program and is being funded in part by the State Congestion Mitigation and Air Quality (CMAQ) program. Programs supported by the improved sidewalk connectivity near Wilson and Pecan Creek Elementary will enhance safety and the ability for students to walk and bike to school. The City of Denton selected projects in coordination with the Denton Independent School District and has identified both Wilson and Pecan Creek elementary schools as candidates in need of sidewalk infrastructure. The current estimated cost including design, right-of-way acquisition, utility relocation, city staff time, and construction of these sidewalks is $676,000. This project has also been approved for the Denton County Transportation Authority’s (DCTA) fiscal year 2021, Transportation Reinvestment Program (TRiP) funding in the not-to-exceed amount of $80,475.00. Any additional funding needed to complete the project will be funded by the 2019 Bond Election Sidewalks Program. Amendment No. 1 provided for the survey and design of Glenwood and Hanover Streets sidewalk additions. City Hall 215 E. These acquisitions are needed prior to our August 2023 TxDOT set-letting schedule. These services will be performed under the guidance of our Real Estate Department. Request for Qualifications for professional engineering services was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms on March 6, 2018, and June 5, 2018 (Ordinance 2018-331). PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On March 6, 2018, and June 5, 2018, Council approved RFQ 6590 for a prequalified list of professional engineering firms (Ordinance 2018-331). On March 16, 2021, Council approved the Professional Service Agreement with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $150,000 (Ordinance 2021-420). On February 4, 2022, Purchasing approved Amendment No. 1 with Kimley-Horn and Associates, Inc., in the not-to-exceed amount of $36,500, for a total not-to-exceed amount of $186,500. RECOMMENDATION Award Amendment No. 2 with Kimley-Horn and Associates, Inc., for additional professional engineering services in support of the Nette Shultz (formerly Wilson) Elementary School and Pecan Creek Elementary School Safe Routes to Schools Sidewalk Improvements project, in a not-to-exceed amount of $120,000, for a total amended contract amount of $306,500.
