Exhibit 1 - Agenda Information Sheet - Amendment 1City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: March 21, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a first amendment to a contract between the City of Denton and Patel & Patel General Partners dba Deluxe Inn, amending the contract approved by the City Council on December 7, 2021, in the not-to-exceed amount of $1,000,000.00; said first amendment to continue to provide accommodations for persons experiencing homelessness during the declared disaster related to COVID-19 for the Community Development Department; providing for the expenditure of funds therefor; and providing an effective date (RFP 7829 – providing for an additional first amendment expenditure amount not-to-exceed $250,000.00, with the total contract amount not-to-exceed $1,250,000.00). INFORMATION/BACKGROUND In December of 2021, City Council approved a contract (RFP 7829) with Patel & Patel General Partners dba Deluxe Inn, to provide accommodations for persons experiencing homelessness during the declared disaster related to COVID-19. This contract is funded through American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds (SLFRF). These services ensure persons experiencing homelessness due to the ongoing impact of the pandemic have access to shelter and supportive services to obtain housing. In September of 2022, Council approved the allocation of an additional $2.5M from the City’s second tranche of ARPA – SLFRF funding for Temporary Alternative Shelter to support ongoing COVID-19 economic recovery efforts. Included in this allocation is funding to sustain temporary shelter accommodations through December 2024. The not-to-exceed amount of funding for this contract is projected to be fully expended as of April 2023. Staff is requesting approval for an additional 25% of the contract amount, $250,000, estimated to sustain the program through November 2023. Staff is currently preparing for the necessary next steps to procure these services beyond November 2023 through December 2024. Since funding has already been allocated to support these efforts, the staff is requesting Council approve the additional 25% of the original contracted funding amount for Patel & Patel General Partners dba Deluxe Inn. PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS) On December 7, 2021, City Council approved a contract with Patel & Patel General Partners dba Deluxe Inn, in the not-to-exceed amount of $1,000,000 (Ordinance 21-2575). FISCAL INFORMATION These services will be funded by American Rescue Plan (ARP) Act Funds. The City will only pay for services rendered and is not obligated to pay the full contract amount unless needed.
