SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
rejecting any and all competitive proposals under RFP 8138 for general Substation Construction and Site
Preparation services; and providing an effective date (RFP 8138). The Public Utilities Board recommends
approval (6 - 0).
INFORMATION/BACKGROUND
Request for Proposal (RFP) 8138 was advertised for Substation Construction and Site Preparation services
for multiple approved Denton Municipal Electric (DME) Capital Improvement Projects (CIP). The intent
of RFP 8138 was to obtain a contract that would cover the needs of DME for multiple projects over multiple
years.
Four proposals were received with only two proposals submitting all required documents. The two received
proposals did not meet the specifications in the scope of work. The specification requires: “The contractor
shall perform directly, and without subcontracting, not less than seventy-five percent (75%) of the
construction of any project, excluding site preparation.” and “Please list five (5) similar projects within
the last ten (10) years.” One proposer has only site preparation services and will subcontract substation
construction. The other proposer is a newly established company, listed only three projects, and did not
reflect the experience needed for the DME CIP projects. Neither proposal meets the standards DME requires
for its capital improvement projects.
DME plans to solicit the substation construction and site preparation services in the future which will be
done individually as needed for each project.
In accordance with Local Government Code 252.043, the City Council may reject any and all bids.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On April 10, 2023, the Public Utilities Board (PUB) recommended this item to the City Council for
consideration.
RECOMMENDATION
Staff recommends rejection of all proposals for RFP 8138 for general Substation Construction and Site
Preparation services.
