Exhibit 1 - Agenda Information SheetCity of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: July 18, 2023 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the City Manager to execute a Professional Services Agreement with POWER Engineers, Inc., for engineering services associated with capital improvement projects for Denton Municipal Electric; providing for the expenditure of funds therefor; and providing an effective date (RFQ 8031-003 – Professional Services Agreement for engineering services awarded to POWER Engineers, Inc., in the not- to-exceed amount of $2,700,000.00). The Public Utilities Board recommends approval (4 - 0). STRATEGIC ALIGNMENT This action supports Key Focus Area: Enhance Infrastructure and Mobility. INFORMATION/BACKGROUND Denton Municipal Electric (DME) requires the services of consultants for professional engineering services to aid in the development and design of approved capital improvement projects electric transmission line projects, to provide relay testing and commissioning services, and general consulting technical support as needed. Over time, there will not be sufficient work to justify having structural, and other specialized engineers on staff that possess the specialized expertise necessary to design transmission line projects. Using outside engineering resources is an efficient and reasonable method for obtaining the temporary and specialized services needed. DME currently has the personnel to perform relay testing and commissioning services. POWER Engineers will assist DME personnel when the workload necessitates or as needed in emergencies. Request for Qualifications of state-certified engineers for substation and transmission line engineering for various projects for Denton Municipal Electric was solicited using the City’s formal solicitation process. City Council approved a pre-qualified list of professional service firms on December 13, 2022 (Ordinance 22-2483). The pre-qualified list of consultants was reranked for the projects shown in the breakdown below and Power Engineers, Inc. ranked highest. The amount proposed for this contract was calculated by estimating the man-hours required for the completion of substation design work for all DME substation capital projects for the next five years. Below are summaries of the estimated cost breakdown of the proposed contract. Changes in schedules, changes in priorities, unforeseen requirements, or the addition of new projects could alter which projects are undertaken within a given time. The contract is structured to be billed on an hourly basis for work performed so that, should needs arise that are not related to the specific projects that were used to construct the estimate for this amendment, POWER Engineers can be used as a resource for DME City Hall 215 E. It should also be noted that the contract does not obligate DME to provide work up to the contract amount or to make any minimum expenditure. On July 10, 2023, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award a contract with POWER Engineerings, Inc., for capital improvement projects requiring professional engineering services, in a not-to-exceed amount of $2,700,000.
