SUBJECT
Adoption of contract through The Interlocal Purchasing System (TIPS) Cooperative Purchasing Network
Contract Number 230405 with INDUSTRIAL POWER. LLC DBA INDUSTRIAL POWER TRUCK AND
EQUIPMENT., for the acquisition of services and products for the City of Denton on February 2, 2021, in
the not-to-exceed amount of $180,000; said first amendment to provide additional service until the TIPS
COOPERATIVE 230405 expires on June 30, 2026; providing for expenditures of funds therefor; and
providing an effective date (File 7607 – providing for an additional first amendment expenditure amount
not-to-exceed $45,000, with the total contract amount not-to-exceed $225,000).
BACKGROUND
Chapter 271.102 of the Local Government Code authorizes local governments to participate in a cooperative
purchasing program with another local government or local cooperative organization. In lieu of competitive
bidding, items, and services may be purchased through such agreements as the agreements have already
been bid by the sponsoring entity or agency. Pricing obtained through the Department of Information
Resources (DIR) Cooperative Purchasing Network has been competitively bid and meets the statutory
requirements of Texas Local Government Code 271.102.
The original contract was awarded on February 2, 2021, not-to-exceed $180,000 with Industrial Power.

replaced by 230405 that expires 6/30/2026
RECOMMENDATION
To provide an additional not-to-exceed amount $45,000 with this First Amendment for an aggregate not-
to-exceed amount of $225,000.
