SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a Professional Services Agreement between the City of
Denton and D&S Engineering Labs, LLC, amending the contract approved by the City Council on
September 14, 2021, in the not-to-exceed amount of $175,300.70; amended by Amendment 1 approved by
Purchasing; said second amendment to provide materials testing for the Police Headquarters, Substation,
and Firing Range for the Police Department; providing for the expenditure of funds therefor; and providing
an effective date (File 7703-001 – providing for an additional second amendment expenditure amount not-
to-exceed $80,000.00, with the total contract amount not-to-exceed $305,299.70).

INFORMATION/BACKGROUND
A contract with D&S Engineering was executed on July 20, 2021, to provide professional services related
to material testing in support of the Denton Public Service Bond projects. The original contract was for an
amount not-to-exceed $175,300.70. Due to additional work, the first amendment to this contract was
executed on May 20, 2022, and brought the new not-to-exceed amount to $225,299.70. Project delays as
well as unanticipated work have resulted in the need to execute a second amendment to this contract which
will include a scope to complete the Denton Public Safety Bond projects.
Request for Qualifications for materials testing services for Facilities Management was solicited using the
City’s formal solicitation process. City Council approved a pre-qualified list of professional service firms
on July 20, 2021 (Ordinance 21-1437).
PRIOR ACTION/REVIEW (Council, Boards, Commissions)
On July 20, 2021, City Council approved RFQ 7703 for a prequalified list of material testing firms for
vertical construction projects (Ordinance 21-1437).
On September 14, 2021, City Council approved a contract with D&S Engineering Labs, LLC in the not-to-
exceed amount of $175,300.70 (Ordinance 21-1888).

RECOMMENDATION
Award Amendment No. 2 with D&S Engineering Labs, LLC, to provide materials testing for the Police
Headquarters, Substation, and Firing Range for the Police Department, in a not-to-exceed amount of
$80,000, for a total amended contract amount of $305,299.70.

FISCAL INFORMATION
These services will be funded from BE-19 Police Station account 100264473.1360.21100. Purchase Order
# 197739 will be revised to include the second amendment amount of $80,000. The total amended amount
of this contract is $305,299.70.
