SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a second amendment to a Professional Services Agreement between the City of
Denton and Kimley-Horn and Associates, Inc., amending the contract approved by City Council on
February 1, 2022, in the not-to-exceed amount of $113,137.00; amended by Amendment 1 approved by
Purchasing; said second amendment to provide additional engineering design services related to the
TXDOT I-35 Aesthetic Package for the Capital Projects Department; providing for the expenditure of funds
therefor; and providing an effective date (RFQ 7599-007 – providing for an additional second amendment
expenditure amount not-to-exceed $25,765.00, with the total contract amount not-to-exceed $188,802.00).

INFORMATION/BACKGROUND
The Texas Department of Transportation (TxDOT) is in the process of redesigning and reconstructing its
overpasses and underpasses along a section of the Interstate-35 (IH-35) corridor named the Gateway
Character Zone. The City of Denton is one of two cities identified in this zone to receive baseline and accent
aesthetic treatments for the proposed improvements.
As part of the community outreach, TxDOT has contacted the City of Denton to incorporate design elements
that are reflective of the Denton community. TxDOT has developed and offered its Aesthetic Design
Guidelines to help communities create an overall corridor of design continuity while maintaining our City
of Denton identity.
On February 1, 2022, the City Council awarded a professional services agreement with Kimley-Horn &
Associates, Inc., for the engineering design services of the TxDOT I-35 Aesthetics Package, including the
development of conceptual and schematic design plans. A First Amendment was approved by the
Purchasing Department on October 11, 2022, which built upon the original contract to prepare the design
development plans to submit to TxDOT.
Through TxDOT’s plan review process, it was identified the intersections at IH-35 & University Drive and
IH-35 & Bonnie Brae Street need to be redesigned due to changes in their policy and plan set. This Second
Amendment covers the required revisions to the project plan set, in collaboration with Texas Women’s
University.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 18, 2021, City Council approved RFQ 7599 for a prequalified list of professional engineering firms
(Ordinance 21-894).
On February 1, 2022, City Council approved a professional services agreement with Kimley-Horn and
Associates, Inc., in the not-to-exceed amount of $113,137 (Ordinance 22-265).
RECOMMENDATION
Award Amendment No. 2 with Kimley-Horn and Associates, Inc., for additional engineering design
services related to the TXDOT I-35 Aesthetic Package for the Capital Projects Department, in a not-to-
exceed amount of $25,765, for a total amended contract amount of $188,802.

ESTIMATED SCHEDULE OF PROJECT
The TxDOT project has a letting date of September 2023 and is anticipated that the construction of the
interstate highway improvements will begin in 2024.
FISCAL INFORMATION
These services will be funded from Parks I35 Public Art project account 450009474.1365.20100. Purchase
Order #199660 will be revised to include the second amendment amount of $25,765. The total amended
amount of this contract is $188,802.
