SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a contract between the City of Denton and Thelin
Recycling Company, LP, amending the contract approved by the City Council on August 13, 2019, in the
not-to-exceed amount of $1,150,000.00; said first amendment to continue to provide brush and wood
grinding services for the Beneficial Reuse Department; providing for the expenditure of funds therefor; and
providing an effective date (RFP 7085 – providing for an additional first amendment expenditure amount
not-to-exceed $287,500, with the total contract amount not-to-exceed $1,437,500.00).

INFORMATION/BACKGROUND
The City of Denton Beneficial Reuse Department contracts out the on-site grinding of wood waste for its
compost operation. Wood waste is collected by the Solid Waste Department. Instead of disposing of the
waste in the landfill, it is diverted to the compost operation, saving valuable space in the landfill. The wood
waste mixed in with the bio-solids from the Pecan Creek Water Reclamation Plant is used to create a green
compost product that is sold to the public and landscape contractors.
The Beneficial Reuse Department is currently under contract with Thelin Recycling Company, L.P. for
Brush and Wood Grinding Services. The current contract (RFP 7085) was approved on August 13, 2019,
for $1,150,000 for a term of 5 years and currently is at 100 percent spend. During this past year, the vendor
passed along a price increase of $1.56 / cubic yard. Additionally, Solid Waste has been experiencing a
significant increase in the amount of brush being disposed of at the landfill. Additional funding is needed
to ensure that the department can continue to process the incoming brush for use in Dyno Dirt products.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On August 13, 2019, City Council approved a contract with Thelin Recycling Company, LP, in the not-to-
exceed amount of $1,150,000 (Ordinance 19-1837).
On October 23, 2023, this item will be presented to the Public Utilities Board (PUB) for consideration.

RECOMMENDATION
Award Amendment No. 1 with Thelin Recycling Company, LP, to continue to provide brush and wood
grinding services for the Beneficial Reuse Department, in a not-to-exceed amount of $287,500, for a total
amended contract amount of $1,437,500.

FISCAL INFORMATION
These services will be funded from Operating Budget account 640400.7802. Requisitions will be entered
on an as-needed basis. The total amended amount of this contract is $1,437,500. The City will only pay for
services rendered and is not obligated to pay the full contract amount unless needed.
