SUBJECT
Consider approval of an ordinance of the City of Denton, Texas, a Texas home-rule municipal corporation,
authorizing the approval of a third amendment to a Professional Services Agreement between the City of
Denton and RPS Infrastructure, Inc., amending the contract approved by City Council on September 18,
2018, in the not-to-exceed amount of $2,031,479.50, amended by Amendments 1 and 2 approved by City
Council; said third amendment to provide engineering and design services relating to the Bonnie Brae Phase
6 - West University Drive (US 380) to North Elm Street (US 77) street improvement project for the Capital
Projects Department; providing for the expenditure of funds therefor; and providing an effective date (RFQ
6590-032 – providing for an additional third amendment expenditure amount not-to-exceed $368,038.20,
with the total contract amount not-to-exceed $3,137,886.70).

INFORMATION/BACKGROUND
The Bonnie Brae Phase 6 project is a street improvement project to reconstruct the two-lane roadway to a
four-lane divided roadway. The project is part of the 2014 General Bond Election. The original limits of
this project were from West University Drive to West Windsor Drive. Since then, the roadway segment
from West Windsor Drive to North Elm Street (US-77) was added due to it becoming part of the 2019
General Bond Election. This roadway segment also became eligible to receive RTR (Regional Toll
Revenue) funding. As such, the plans and project manual need to meet the
Texas Department of Transportation (TxDOT) standards and receive the TxDOT letter of approval.
The original scope of services included items such as schematic and detailed design, traffic analysis,
geotechnical investigations, floodplain analysis, environmental services, and utility coordination.
Amendment #1 included additional services that were required by TxDOT due to the road being widened
from 2 lanes undivided to 4 lanes divided. A noise study was also completed to acquire the RTR funding.
Amendment #2 includes additional design work and management for the acceptance of federal funding. It
also includes bid phase services for project advertising/award, as well as construction phase services
including Request For Information/submittal reviews, project meetings, Texas Department of Licensing
and Regulation (TDLR) review and approval, final walk-through and punch list preparation.

Amendment #3 will include additional services for design work and project management that have been
needed to interact with developers throughout the project site. Additional services for assistance with
reimbursements and services to coordinate with TxDOT for final acceptance. The bid phase and
construction phase services will be reassessed to prepare for construction.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 6, 2018, and June 5, 2018, the City Council approved RFQ 6590 for a prequalified list of
professional engineering firms (Ordinance 2018-331).
On September 18, 2018, the City Council approved a contract with RPS Infrastructure, Inc., for the design
of the Bonnie Brae Phase 6 Improvement Project (Ordinance 18-1429).
On March 26, 2019, City Council approved Amendment No. 1 with RPS Infrastructure, Inc., in the not-to-
exceed amount of $397,760, for a total not-to-exceed amount of $2,429,239.50 (Ordinance 19-602).
On October 27, 2020, the City Council approved Amendment No. 2 with RPS Infrastructure, Inc., in the
not-to-exceed amount of $340,609, for a total not-to-exceed amount of $2,769,848.50 (Ordinance 20-1994).
RECOMMENDATION
Award Amendment No. 3 with RPS Infrastructure, Inc., to provide engineering and design services relating
to the Bonnie Brae Phase 6 - West University Drive (US 380) to North Elm Street (US 77) street
improvement project for the Capital Projects Department, in a not-to-exceed amount of $368,038.20, for a
total amended contract amount of $3,137,886.70.

ESTIMATED SCHEDULE OF PROJECT
This project is projected to have 100% design by December 2023 and then will advertise the project in
February 2024 pending TxDOT approval of plans and project manual.
FISCAL INFORMATION
These services will be funded from the City of Denton Bonnie Brae Phase 6 account
250076467.1360.21100. Purchase Order #186873 will be revised to include the third amendment amount
of $368,038.20. The total amended amount of this contract is $3,137,886.70.
