SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the City Manager to execute a Professional Services Agreement with Freese and Nichols, Inc.,
for water supply and hydrology consulting services for the Water Department as set forth in the contract;
providing for the expenditure of funds therefor; and providing an effective date (RFQ 8345 – Professional
Services Agreement for consulting services awarded to Freese and Nichols, Inc., for three (3) years, with
the option for two (2) additional one (1) year extensions, in the total five (5) year not-to-exceed amount of
$1,250,000.00).

INFORMATION/BACKGROUND
As the City of Denton’s population and industrial institutions continue to grow, the water demand is
increasing. Denton Water Utilities is working to ensure that a safe and reliable water supply exists in the
near and long term. Denton’s climate and geography present limited water resources, therefore calculating
water needs and availability for the future is complex. The City is seeking the expert skills of a Hydrologist
to assist in supply and demand projections to help guide decision-making for future planning.
The Hydrologist will assist the department by reviewing current water availability from a supply standpoint
and treatment capacity, then work with the department to identify potential future supply and treatment
capacity/ availability models. This work will also include permitting application support, where needed to
maintain existing and/ or secure the additional identified supply. These models are driven by different
scenarios of growth and water resource availability projections. The hydrologist will further provide
calculations and methodology to support detailed accounting methods for different water draw, storage, and
release scenarios to identify the best and most appropriate model for the department’s long-term success.
A request for qualifications was Freese and Nichols’ history of partnering with Region C, the water planning
region in which Denton resides, which has demonstrated continued success in the identification and
acquisition of water resources for growing populations. Additionally, Freese and Nichols understand the
competing needs and priorities at play within Region C amongst other cities competing for resources within
the area and are currently working on the long-range water supply plan for the entire region.

Request for Qualifications (RFQ) for professional consulting services was sent to 1,090 prospective firms
for these services, including 43 Denton firms. In addition, the RFQ was placed on the Procurement website
for prospective respondents to download, and advertised in the local newspaper. One (1) statement of
qualifications (SOQ) was received and references were checked to ensure the vendor could provide the
services requested in the Scope of Work. The proposal was evaluated based upon published criteria
including. The SOQs were evaluated based on published criteria including work plan, probable
performance, compliance with specifications, and needs of the City. Based upon this evaluation, the
recommended award is to Freese and Nichols, Inc., and is determined to be the most qualified firm for the
City.

RECOMMENDATION
Award a contract with Freese and Nichols, Inc., for water supply and hydrology consulting services for the
Water Department, in a three (3) year, with the option for two (2) additional one (1) year extensions, in the
total five (5) year not-to-exceed amount of amount of $1,250,000.

ESTIMATED SCHEDULE OF PROJECT
This is an initial three (3) year contract with options to extend the contract for two (2) additional one (1)
year periods, with all terms and conditions remaining the same.
FISCAL INFORMATION
These Water Supply and Hydrology Consulting Services will be funded from Water Administration account
630001.7854. Requisition #162847 has been entered into the Purchasing software system in the amount of
$250,000. The budgeted amount for this item is $1,250,000. The City will only pay for services rendered
and is not obligated to pay the full contract amount unless needed.
