Exhibit 1 - Agenda Information Sheet - Amendment 2City of Denton _____________________________________________________________________________________ AGENDA INFORMATION SHEET DEPARTMENT: Procurement ACM: Cassey Ogden DATE: February 6, 2024 SUBJECT Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation, authorizing the approval of a second amendment to a Professional Services Agreement between the City of Denton and Biggs and Mathews Environmental, Inc., amending the contract approved by the City Council on June 7, 2022, in the not-to-exceed amount of $160,000.00; amended by Amendment 1 approved by Purchasing; said second amendment to provide additional scale facility and roadway improvements for the Solid Waste and Recycling Department; providing for the expenditure of funds therefor; and providing an effective date (File 7109-025 – providing for an additional second amendment expenditure amount not-to- exceed $50,000.00, with the total contract amount not-to-exceed $259,358.00). INFORMATION/BACKGROUND The Scale House was constructed in 2007 and has operated for 15 years. The Solid Waste Department offers serval programs and services, many taking place at the Landfill with final transactions at the Scale House. As the City of Denton and surrounding regions grow, so does the traffic at the Landfill’s Scale House. When the Scale House was first opened, it was managing transactions of about 600 tons of waste per day. Currently, it is averaging approximately 1,800 tons a day. The Solid Waste Department seeks to improve site access roads, scale wait times, traffic flow, and safety concerns under the current system, and expedite and manage traffic with efficacy and safety. Amendment 1 of the contract included hiring an Architect for the interior design of the Scale House building and the preparation of various construction documents but did not include funds for construction administration. Amendment 2 includes: • Changes to the HVAC design requested by Facilities; and • Provide additional funds for Construction Administration and general Architect/Engineer oversight throughout the project. City Council approved a pre-qualified list of engineering firms on October 8, 2019 (Ordinance 19-2305). PRIOR ACTION/REVIEW (Council, Boards, Commissions) On October 8, 2019, City Council approved RFQ 7109 for a prequalified list of professional engineering firms (Ordinance 19-2305). On June 7, 2022, City Council approved a contract with Biggs and Mathews Environmental, Inc., in the not-to-exceed amount of $160,000 (Ordinance 22-1104). On January 22, 2024, the Public Utilities Board (PUB) recommended this item to the City Council for consideration. RECOMMENDATION Award Amendment No. 2 with Biggs and Mathews Environmental, Inc., to provide additional scale facility and roadway improvements for the Solid Waste and Recycling Department, in a not-to-exceed amount of $50,000, for a total amended contract amount of $259,358. Mansfield, TX ESTIMATED SCHEDULE OF PROJECT The estimated project schedule includes four (4) months for Preliminary Design, four (4) months for Final Design, three (3) months for Services, one (1) year for Construction Management, one (1) year for Construction Quality Assurance, and two (2) months on Final Construction Report. FISCAL INFORMATION These services will be funded from Solid Waste project account 660904585.1365.21100. Purchase Order #200326 will be revised to include the second amendment amount of $50,000. The total amount of this contract is $259,358.
