SUBJECT
Consider adoption of an ordinance of the City of Denton, a Texas home-rule municipal corporation,
authorizing the approval of a first amendment to a Professional Services Agreement between the City of
Denton and HDR Engineering, Inc., amending the contract approved by City Council on November 1, 2022,
in the not-to-exceed amount of $217,106.50, said first amendment to provide Lead and Copper Public
Outreach and Crisis Communication Plan for the Water Department; providing for the expenditure of funds
therefor; and providing an effective date (RFQ 7574-019 – providing for an additional first amendment
expenditure amount not-to-exceed $93,375.50, with the total contract amount not-to-exceed $310,482.00).
INFORMATION/BACKGROUND
On December 16, 2021, the United States Environmental Protection Agency (USEPA) updated the Lead
and Copper Rule (LCR). These revisions, titled Lead and Copper Rule Revisions (LCRR), put in place a
framework designed to address lead and copper in drinking water systems. Part of this framework focuses
specifically on the areas of public education and communication regarding lead and copper, health risks,
and lead service line replacement. The revised rule also requires that utilities engage with schools and day-
care facilities to educate them regarding the risk of lead in drinking water and the new sampling required
for these facilities by the rule. Another important requirement of the revised LCRR is a crisis
communications plan should the trigger and action levels of lead be exceeded. The new communication
requirements under the LCRR must be implemented by October 2024.
The LCRR has requirements that will affect utilities in multiple ways, including new testing requirements,
treatment requirements, service line identification/replacements, as well as public outreach/notification.
The scope of the original contract awarded included:
• Developing a road map for LCRR compliance;
• Developing a Public Outreach Strategy in compliance with the LCRR;
• Develop Public Outreach Materials/Toolkits;
• Developing a Crisis Communications Plan;
• Providing On-Call Support;
• Providing Project Management Services.
In addition to the initial communications plan deliverables, it was determined that an inventory replacement
plan and a communications tool kit will need to be created once the lead inventory has been established and
quantified. Denton Water Utilities recommends an amendment to the existing contract which would allow
for the completion of the following additional deliverables:

• Inventory replacement plan
• A response plan training for staff
• Communication kit for staff and elected officials
Additionally, the Lead and Copper Replacement Improvements (LCRI) rules are continuing to evolve, and
part of the challenge facing utilities is compliance by October 2024 to a set of evolving regulations. As part
of the deliverables for this amendment, HDR will provide updates regarding the changes with the planned
LCR Improvements, including TCEQ and EPA guideline changes and recommended updates to the
response plan and replacement roadmap.
HDR Engineering, Inc. is prequalified by RFQ 7574 received by the Purchasing Department. Staff elected
to solicit a formal scope and fee proposal from HDR Engineering, Inc. based on the firm’s experience and
staff.
Request for Qualifications for professional engineering services for Water and Wastewater was solicited
using the City’s formal solicitation process. City Council approved a pre-qualified list of engineering firms
on March 23, 2021 (Ordinance 21-546).
PRIOR ACTION/REVIEW (Council, Boards, Commissions)
On March 23, 2021, City Council approved RFQ 7574 for a prequalified list of professional engineering
firms for Water and Wastewater (Ordinance 21-546).
On November 1, 2022, City Council approved a contract with HDR Engineering, Inc., in the not-to-exceed
amount of $217,106.50 (Ordinance 22-2193).
This item will be presented to the Public Utilities Board (PUB) on February 26, 2024, retroactively, due to
the February 12, 2024 meeting not having a quorum.
RECOMMENDATION
Award Amendment No. 1 with HDR Engineering, Inc., to provide Lead and Copper Public Outreach and
Crisis Communication Plan for the Water Department, in a not-to-exceed amount of $93,375.50, for a total
amended contract amount of $310,482.

FISCAL INFORMATION
These services will be funded from Lead and Copper Public Outreach and Crisis Communication account
630507517.1365.30200. Purchase Order #156953 will be revised to include the first amendment amount of
$93,375.50. The total amount of this contract is $310,482.
