24-293 - 7804-004 - Amendment 1 Ordinacne ExecutedORDINANCE NO. 24-293 AN ORD[NANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION, AUTHORIZING THE APPROVAL OF A FIRST AMENDMENT TO APROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON AND BURNS& MCDONNELL ENGINEERING COMPANY, INC., AMENDING THE CONTRACTAPPROVED BY CITY COUNCIL ON AUGUST 16, 2022, IN THE NOT-TO-EXCEEDAMOUNT OF $387,500.00, SAID FIRST AMENDMENT TO CONTINUE TO MANAGE ANDCONTROL THE GEOMETRIC NETWORK TO A UTILITY NETWORK IN THE CAPACITYOF OWNER'S ENGINEER TO DENTON MUNICIPAL ELECTRIC; PROVIDING FOR THE EXPENDITURE OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (RFQ7804-004 – PROVIDING FOR AN ADDITIONAL FIRST AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED $65,000.00, FOR A TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $452,500.00). WHEREAS, on August 16, 2022, City Council awarded a contract to Burns & McDonnell Engineering Company, Inc. in the amount of $387,500.00, to manage and control the geometric network to a utility network in the capacity of Owner's Engineer to Denton Municipal Electric; and WHEREAS, this procurement was undertaken as part of the City’s governmental function; and WHEREAS, the additional fees under the proposed First Amendment are fair and reasonable and are consistent with, and not higher than, the recommended practices and fees applicable to theProvider’s profession, and such fees do not exceed the maximum provided by law; NOW, THEREFORE, THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS: SECTION 1. The First Amendment, increasing the amount of the contract between the City and Burns & McDonnell Engineering Company, Inc., which is on file in the office of the Purchasing Agent, in the amount of Sixty-Five Thousand and 0/100 ($65,000.00) Dollars, is hereby approved, and the expenditure of funds therefor is hereby authorized in accordance with said amendment which shall be effective upon the execution of the amendment attached hereto. The total contract amount increases to $452,500.00. SECTION 2.
