AN ORDINANCE OF THE CITY OF DENTON, A TEXAS HOME-RULE MUNICIPALCORPORATION. AUTHORIZING THE APPROVAL OF A THIRD AMENDMENT TO APROFESSIONAL SERVICES AGREEMENT BETWEEN THE CITY OF DENTON ANDHOWELL DESIGN GROUP, LLC (HDG), AMENDING THE CONTRACT APPROVED BYPURCHASING ON MAY 28, 2021, IN THE NOT-TO-EXCEED AMOUNT OF $45,000.00;AMENDED BY AMENDMENTS 1-2 APPROVED BY CITY COUNCIL; SAID THIRDAMENDMENT FOR ADDITIONAL SECURITY CONSULTING AND DESIGN SERVICES FORTHE FACILITIES MANAGEMENT DEPARTMENT; PROVIDING FOR THE EXPENDITURE
OF FUNDS THEREFOR; AND PROVIDING AN EFFECTIVE DATE (PSA 7723 – PROVDnqGFOR AN ADDITIONAL THIRD AMENDMENT EXPENDITURE AMOUNT NOT-TO-EXCEED
$ 150,000.00, WITH THE TOTAL CONTRACT AMOUNT NOT-TO-EXCEED $797,300.00).
WHEREAS, on May 28, 2021, Purchasing awarded a contract to Howell Design Group, LLC
(HDG), in the amount of $45,000.00, for security consulting services; and
WHEREAS, on November 2, 2021, City Council awarded a First Amendment to Howell
Design Group, LLC (HDG) in the amount of $75,000.00, to continue to provide security consultingservices; and
WHEREAS, on April 18, 2023, City Council awarded a Second Amendment to Howell
Design Group, LLC (HDG) in the amount of $527,300.00, to continue to provide security consultingservices; and
WHEREAS, this procurement was undertaken as part of the City’s governmental
function; and
WHEREAS, the additional fees under the proposed Third Amendment are fair andreasonable and are consistent with, and not higher than, the recommended practices and fees
applicable to the Provider’s profession, and such fees do not exceed the maximum provided by law;
NOW, THEREFORE,
THE COUNCIL OF THE CITY OF DENTON HEREBY ORDAINS:
SECTION 1. The Third Amendment, increasing the amount of the contract between the City
and Howell Design Group, LLC (HDG), which is on file in the office of the Purchasing Agent, in the
amount of One Hundred Fifty Thousand and 0/100 ($ 150,000.00) Dollars, is hereby approved, and
the expenditure of funds therefor is hereby authorized in accordance with said amendment which
shall be effective upon the execution of the amendment attached hereto. The total contract amountincreases to $797,300.00.
SECTION 2. This ordinance shall become effective immediately upon its passage and
approval
